| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Subchapter I, Chapter 201, Transportation Code, |
|---|
| 12 | 12 | | is amended by adding Section 201.713 to read as follows: |
|---|
| 13 | 13 | | Sec. 201.713. REIMBURSEMENT OF EXCESS COSTS INCURRED BY |
|---|
| 14 | 14 | | CERTAIN GRANT RECIPIENTS. (a) This section applies only to a grant |
|---|
| 15 | 15 | | awarded by the department for the construction of a transportation |
|---|
| 16 | 16 | | project in a county with a population of less than 25,000 or a |
|---|
| 17 | 17 | | municipality with a population of less than 15,000. |
|---|
| 18 | 18 | | (b) The department shall reimburse a grant recipient for |
|---|
| 19 | 19 | | costs incurred by the recipient that exceed the amount of the grant |
|---|
| 20 | 20 | | awarded by the department if the construction of the transportation |
|---|
| 21 | 21 | | project is managed by the department. |
|---|
| 22 | 22 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 23 | 23 | | to a grant awarded by the Texas Department of Transportation on or |
|---|
| 24 | 24 | | after the effective date of this Act. A grant awarded before the |
|---|
| 25 | 25 | | effective date of this Act is governed by the law in effect on the |
|---|
| 26 | 26 | | date the award was made, and the former law is continued in effect |
|---|
| 27 | 27 | | for that purpose. |
|---|
| 28 | 28 | | SECTION 3. This Act takes effect September 1, 2023. |
