55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to a local remote learning program offered by certain
88 school districts or open-enrollment charter schools.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 29.9091, Education Code, is amended by
1111 amending Subsections (n) and (s) and adding Subsection (n-1) to
1212 read as follows:
1313 (n) Except as otherwise provided under Subsection (e)(3) or
1414 (n-1), a student enrolled in a virtual course offered under a local
1515 remote learning program shall be counted toward the school
1616 district's or open-enrollment charter school's average daily
1717 attendance in the same manner as other district or school students.
1818 The commissioner shall adopt rules providing for a method of taking
1919 attendance, once each school day, for students enrolled in a
2020 virtual course offered under a local remote learning program.
2121 (n-1) A school district or open-enrollment charter school
2222 that operates a local remote learning program is entitled to
2323 funding under Chapters 46 and 48 or Section 12.106 for a student's
2424 enrollment in a virtual course offered under the program only if the
2525 student successfully completes the course.
2626 (s) This section expires September 1, 2026 [2023].
2727 SECTION 2. This Act applies beginning with the 2023-2024
2828 school year.
2929 SECTION 3. This Act takes effect immediately if it receives
3030 a vote of two-thirds of all the members elected to each house, as
3131 provided by Section 39, Article III, Texas Constitution. If this
3232 Act does not receive the vote necessary for immediate effect, this
3333 Act takes effect September 1, 2023.
