| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 29.9091, Education Code, is amended by |
|---|
| 11 | 11 | | amending Subsections (n) and (s) and adding Subsection (n-1) to |
|---|
| 12 | 12 | | read as follows: |
|---|
| 13 | 13 | | (n) Except as otherwise provided under Subsection (e)(3) or |
|---|
| 14 | 14 | | (n-1), a student enrolled in a virtual course offered under a local |
|---|
| 15 | 15 | | remote learning program shall be counted toward the school |
|---|
| 16 | 16 | | district's or open-enrollment charter school's average daily |
|---|
| 17 | 17 | | attendance in the same manner as other district or school students. |
|---|
| 18 | 18 | | The commissioner shall adopt rules providing for a method of taking |
|---|
| 19 | 19 | | attendance, once each school day, for students enrolled in a |
|---|
| 20 | 20 | | virtual course offered under a local remote learning program. |
|---|
| 21 | 21 | | (n-1) A school district or open-enrollment charter school |
|---|
| 22 | 22 | | that operates a local remote learning program is entitled to |
|---|
| 23 | 23 | | funding under Chapters 46 and 48 or Section 12.106 for a student's |
|---|
| 24 | 24 | | enrollment in a virtual course offered under the program only if the |
|---|
| 25 | 25 | | student successfully completes the course. |
|---|
| 26 | 26 | | (s) This section expires September 1, 2026 [2023]. |
|---|
| 27 | 27 | | SECTION 2. This Act applies beginning with the 2023-2024 |
|---|
| 28 | 28 | | school year. |
|---|
| 29 | 29 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 30 | 30 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 31 | 31 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 32 | 32 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 33 | 33 | | Act takes effect September 1, 2023. |
