| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Subchapter H, Chapter 242, Health and Safety |
|---|
| 12 | 12 | | Code, is amended by adding Section 242.2015 to read as follows: |
|---|
| 13 | 13 | | Sec. 242.2015. TRAINING REQUIREMENT FOR FACILITY PERSONNEL |
|---|
| 14 | 14 | | PROVIDING ALZHEIMER'S CARE; PROHIBITED ADVERTISEMENT. A nursing |
|---|
| 15 | 15 | | facility may not advertise, market, or otherwise promote the |
|---|
| 16 | 16 | | facility's Alzheimer's care unit or memory care unit as providing |
|---|
| 17 | 17 | | services to residents with Alzheimer's disease and related |
|---|
| 18 | 18 | | disorders unless the facility provides the services through |
|---|
| 19 | 19 | | specially trained personnel who have successfully completed a |
|---|
| 20 | 20 | | minimum of four training hours in caring for those residents as |
|---|
| 21 | 21 | | prescribed by commission rule. |

| 22 | 22 | | SECTION 2. Subchapter B, Chapter 247, Health and Safety |
|---|
| 23 | 23 | | Code, is amended by adding Section 247.0297 to read as follows: |
|---|
| 24 | 24 | | Sec. 247.0297. TRAINING REQUIREMENT FOR FACILITY PERSONNEL |
|---|
| 25 | 25 | | PROVIDING ALZHEIMER'S CARE; PROHIBITED ADVERTISEMENT. An assisted |
|---|
| 26 | 26 | | living facility may not advertise, market, or otherwise promote the |
|---|
| 27 | 27 | | facility's Alzheimer's care unit or memory care unit as providing |
|---|
| 28 | 28 | | services to residents with Alzheimer's disease and related |
|---|
| 29 | 29 | | disorders unless the facility provides the services through |
|---|
| 30 | 30 | | specially trained personnel who have successfully completed a |
|---|

| 33 | 33 | | SECTION 3. Not later than December 1, 2023, the executive |
|---|
| 34 | 34 | | commissioner of the Health and Human Services Commission shall |
|---|
| 35 | 35 | | adopt the rules necessary to implement the changes in law made by |
|---|
| 36 | 36 | | this Act. |
|---|
| 37 | 37 | | SECTION 4. The changes in law made by this Act apply only to |
|---|
| 38 | 38 | | advertising, marketing, or promoting conducted on or after January |
|---|
| 39 | 39 | | 1, 2024. |
|---|
| 40 | 40 | | SECTION 5. This Act takes effect September 1, 2023. |
