77 relating to legislative leave for certain peace officers
88 commissioned by the Parks and Wildlife Department.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter B, Chapter 11, Parks and Wildlife
1111 Code, is amended by adding Section 11.0183 to read as follows:
1212 Sec. 11.0183. DONATION OF ACCRUED COMPENSATORY TIME OR
1313 ACCRUED ANNUAL LEAVE FOR LEGISLATIVE PURPOSES. (a) The director
1414 shall allow a peace officer commissioned by the department to
1515 voluntarily transfer to a legislative leave pool up to eight hours
1616 of compensatory time or annual leave per year earned by the peace
1717 officer.
1818 (b) The director or the director's designee shall
1919 administer the legislative leave pool.
2020 (c) The commission shall adopt rules and prescribe
2121 procedures relating to the operation of the legislative leave pool.
2222 (d) The director or the director's designee shall credit the
2323 legislative leave pool with the amount of time contributed by a
2424 peace officer commissioned by the department and deduct a
2525 corresponding amount of time from the peace officer's earned
2626 compensatory time or annual leave as if the peace officer had used
2727 the time for personal purposes.
2828 (e) A peace officer commissioned by the department is
2929 entitled to use time contributed to the legislative leave pool if
3030 the peace officer uses the time for legislative leave on behalf of a
3131 law enforcement association:
3232 (1) related to the peace officer's employment with the
3333 department;
3434 (2) that has at least 300 active or retired members;
3535 and
3636 (3) that is governed by a board of directors.
3737 (f) The director or the director's designee shall transfer
3838 time from the pool to the peace officer and credit the time to the
3939 peace officer.
4040 (g) A peace officer commissioned by the department may only
4141 withdraw time from the legislative leave pool in coordination with
4242 and with the consent of the president or designee of the law
4343 enforcement association described in Subsection (e). A peace
4444 officer may not draw more than 80 hours from the pool in a 160-hour
4545 work cycle and may not draw more than 480 hours from the pool in a
4646 fiscal year.
4747 (h) A peace officer commissioned by the department shall use
4848 time from the legislative leave pool in accordance with rules
4949 adopted by the commission.
5050 SECTION 2. This Act takes effect September 1, 2023.
