9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Subchapter B, Chapter 11, Parks and Wildlife |
---|
11 | 11 | | Code, is amended by adding Section 11.0183 to read as follows: |
---|
12 | 12 | | Sec. 11.0183. DONATION OF ACCRUED COMPENSATORY TIME OR |
---|
13 | 13 | | ACCRUED ANNUAL LEAVE FOR LEGISLATIVE PURPOSES. (a) The director |
---|
14 | 14 | | shall allow a peace officer commissioned by the department to |
---|
15 | 15 | | voluntarily transfer to a legislative leave pool up to eight hours |
---|
16 | 16 | | of compensatory time or annual leave per year earned by the peace |
---|
17 | 17 | | officer. |
---|
18 | 18 | | (b) The director or the director's designee shall |
---|
19 | 19 | | administer the legislative leave pool. |
---|
20 | 20 | | (c) The commission shall adopt rules and prescribe |
---|
21 | 21 | | procedures relating to the operation of the legislative leave pool. |
---|
22 | 22 | | (d) The director or the director's designee shall credit the |
---|
23 | 23 | | legislative leave pool with the amount of time contributed by a |
---|
24 | 24 | | peace officer commissioned by the department and deduct a |
---|
25 | 25 | | corresponding amount of time from the peace officer's earned |
---|
26 | 26 | | compensatory time or annual leave as if the peace officer had used |
---|
27 | 27 | | the time for personal purposes. |
---|
28 | 28 | | (e) A peace officer commissioned by the department is |
---|
29 | 29 | | entitled to use time contributed to the legislative leave pool if |
---|
30 | 30 | | the peace officer uses the time for legislative leave on behalf of a |
---|
31 | 31 | | law enforcement association: |
---|
32 | 32 | | (1) related to the peace officer's employment with the |
---|
33 | 33 | | department; |
---|
34 | 34 | | (2) that has at least 300 active or retired members; |
---|
35 | 35 | | and |
---|
36 | 36 | | (3) that is governed by a board of directors. |
---|
37 | 37 | | (f) The director or the director's designee shall transfer |
---|
38 | 38 | | time from the pool to the peace officer and credit the time to the |
---|
39 | 39 | | peace officer. |
---|
40 | 40 | | (g) A peace officer commissioned by the department may only |
---|
41 | 41 | | withdraw time from the legislative leave pool in coordination with |
---|
42 | 42 | | and with the consent of the president or designee of the law |
---|
43 | 43 | | enforcement association described in Subsection (e). A peace |
---|
44 | 44 | | officer may not draw more than 80 hours from the pool in a 160-hour |
---|
45 | 45 | | work cycle and may not draw more than 480 hours from the pool in a |
---|
46 | 46 | | fiscal year. |
---|
47 | 47 | | (h) A peace officer commissioned by the department shall use |
---|
48 | 48 | | time from the legislative leave pool in accordance with rules |
---|
49 | 49 | | adopted by the commission. |
---|
50 | 50 | | SECTION 2. This Act takes effect September 1, 2023. |
