6 | 6 | | relating to a limitation on the salary paid to officers and |

7 | 7 | | employees of this state and political subdivisions of this state. |

8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 9 | | SECTION 1. Subchapter B, Chapter 659, Government Code, is |
---|
10 | 10 | | amended by adding Section 659.0111 to read as follows: |
---|
11 | 11 | | Sec. 659.0111. LIMITATION ON SALARY. Notwithstanding any |
---|
12 | 12 | | other law, the salary of a state officer or employee may not exceed |
---|
13 | 13 | | the amount of the salary set by the biennial appropriations act for |
---|
14 | 14 | | the governor. |
---|
15 | 15 | | SECTION 2. Chapter 180, Local Government Code, is amended |
---|
16 | 16 | | by adding Section 180.010 to read as follows: |

17 | 17 | | Sec. 180.010. LIMITATION ON SALARY FOR OFFICER OR EMPLOYEE |
---|
18 | 18 | | OF POLITICAL SUBDIVISION. (a) In this section, "political |
---|
19 | 19 | | subdivision" means a county, municipality, special district, |
---|
20 | 20 | | school district, junior college district, or other political |
---|
21 | 21 | | subdivision of this state. |
---|
22 | 22 | | (b) Notwithstanding any other law, the salary of an officer |
---|
23 | 23 | | or employee of a political subdivision may not exceed the amount of |
---|
24 | 24 | | the salary set by the General Appropriations Act for the governor. |
---|
25 | 25 | | SECTION 3. This Act applies to a salary agreement or an |
---|
26 | 26 | | employment contract that is entered into on or after September 1, |
---|
27 | 27 | | 2023. A salary agreement or an employment contract that is entered |
---|
28 | 28 | | into before September 1, 2023, is governed by the law as it existed |
---|
29 | 29 | | at the time the agreement or contract was entered into, and the |
---|
30 | 30 | | former law remains in effect for that purpose. |
---|
31 | 31 | | SECTION 4. This Act applies beginning with the state fiscal |
---|
32 | 32 | | biennium that begins September 1, 2023. |
---|
33 | 33 | | SECTION 5. This Act takes effect on September 1, 2023. |
