55 AN ACT
66 relating to a limitation on the salary paid to officers and
77 employees of this state and political subdivisions of this state.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subchapter B, Chapter 659, Government Code, is
1010 amended by adding Section 659.0111 to read as follows:
1111 Sec. 659.0111. LIMITATION ON SALARY. Notwithstanding any
1212 other law, the salary of a state officer or employee may not exceed
1313 the amount of the salary set by the biennial appropriations act for
1414 the governor.
1515 SECTION 2. Chapter 180, Local Government Code, is amended
1616 by adding Section 180.010 to read as follows:
1717 Sec. 180.010. LIMITATION ON SALARY FOR OFFICER OR EMPLOYEE
1818 OF POLITICAL SUBDIVISION. (a) In this section, "political
1919 subdivision" means a county, municipality, special district,
2020 school district, junior college district, or other political
2121 subdivision of this state.
2222 (b) Notwithstanding any other law, the salary of an officer
2323 or employee of a political subdivision may not exceed the amount of
2424 the salary set by the General Appropriations Act for the governor.
2525 SECTION 3. This Act applies to a salary agreement or an
2626 employment contract that is entered into on or after September 1,
2727 2023. A salary agreement or an employment contract that is entered
2828 into before September 1, 2023, is governed by the law as it existed
2929 at the time the agreement or contract was entered into, and the
3030 former law remains in effect for that purpose.
3131 SECTION 4. This Act applies beginning with the state fiscal
3232 biennium that begins September 1, 2023.
3333 SECTION 5. This Act takes effect on September 1, 2023.
