77 relating to the imposition of a county housing first initiatives
88 fee in certain counties.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter B, Chapter 118, Local Government
1111 Code, is amended by adding Section 118.027 to read as follows:
1212 Sec. 118.027. FEE FOR HOUSING FIRST INITIATIVES IN CERTAIN
1313 COUNTIES. (a) This section applies only to a county with a
1414 population of 500,000 or more.
1515 (b) The commissioners court of a county may adopt a housing
1616 first initiatives fee. The fee must be:
1717 (1) adopted by the commissioners court at an open
1818 meeting; and
1919 (2) itemized in the county's annual budget as part of
2020 the budget preparation process.
2121 (c) The fee shall be paid by a person at the time the person
2222 pays a fee under Section 118.011(a)(1) or (2).
2323 (d) The fee shall be deposited in a separate housing first
2424 initiatives account in the general fund of the county. Any interest
2525 that accrues on the account remains with the account.
2626 (e) Revenue collected from the fee may be used only to fund
2727 housing initiatives, including:
2828 (1) emergency shelter expansion;
2929 (2) homelessness prevention services;
3030 (3) street outreach programs;
3131 (4) rapid rehousing programs; and
3232 (5) transitional housing programs.
3333 (f) The county may contract with a private entity, a
3434 nonprofit corporation, or a political subdivision to undertake an
3535 initiative authorized by this section.
3636 SECTION 2. This Act takes effect immediately if it receives
3737 a vote of two-thirds of all the members elected to each house, as
3838 provided by Section 39, Article III, Texas Constitution. If this
3939 Act does not receive the vote necessary for immediate effect, this
4040 Act takes effect September 1, 2023.
