66 AN ACT
77 relating to the creation of a rural county law enforcement grant
88 program.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 403, Government Code, is amended by
1111 adding Subchapter T to read as follows:
1212 SUBCHAPTER T. RURAL COUNTY LAW ENFORCEMENT GRANT PROGRAM
1313 Sec. 403.571. DEFINITION. In this subchapter, "rural
1414 county law enforcement agency" means any of the following if
1515 located in a county with a population of 275,000 or less:
1616 (1) a sheriff's office;
1717 (2) a constable's office;
1818 (3) a district attorney's office;
1919 (4) a criminal district attorney's office; or
2020 (5) a county attorney's office with criminal
2121 prosecution duties.
2222 Sec. 403.572. ESTABLISHMENT OF GRANT PROGRAM. The
2323 comptroller shall establish and administer a grant program through
2424 which a rural county law enforcement agency may apply for a grant
2525 that may be used to pay for:
2626 (1) the salaries of sheriffs, sheriff's deputies,
2727 jailers, or office support staff, including the hiring of
2828 additional deputies, jailers, and office support staff;
2929 (2) the salaries of constables and deputy constables,
3030 including the hiring of additional deputies;
3131 (3) the salaries of assistant prosecuting attorneys,
3232 investigators, victim assistance coordinators, or office support
3333 staff, including the hiring of additional attorneys,
3434 investigators, coordinators, and office support staff;
3535 (4) any costs for the recruitment of staff;
3636 (5) the purchase, lease, or maintenance of equipment,
3737 vehicles, office technology services and hardware, and office
3838 infrastructure and related facilities; and
3939 (6) any costs for personnel training and related
4040 office expenses, including training to obtain or maintain an
4141 accreditation related to the position of the person undergoing the
4242 training.
4343 Sec. 403.573. AMOUNT OF GRANTS. (a) The comptroller shall
4444 award a grant to a rural county law enforcement agency that applies
4545 for the grant using money appropriated to the comptroller for that
4646 purpose.
4747 (b) A rural county law enforcement agency that is a
4848 sheriff's office or constable's office may be awarded a grant of not
4949 more than:
5050 (1) $250,000, if the applicant is located in a county
5151 with a population of less than 10,000;
5252 (2) $350,000, if the applicant is located in a county
5353 with a population of 10,000 or more but less than 50,000; or
5454 (3) $500,000, if the applicant is located in a county
5555 with a population of 50,000 or more but not more than 275,000.
5656 (c) A rural county law enforcement agency that is a district
5757 attorney's office, a criminal district attorney's office, or a
5858 county attorney's office with criminal prosecution duties may be
5959 awarded a grant of not more than:
6060 (1) $100,000, if the applicant is located in a county
6161 with a population of less than 10,000;
6262 (2) $175,000, if the applicant is located in a county
6363 with a population of 10,000 or more but less than 50,000; or
6464 (3) $275,000, if the applicant is located in a county
6565 with a population of 50,000 or more but not more than 275,000.
6666 (d) For purposes of Subsection (c), a multi-county district
6767 attorney's office is considered to be located in the county in the
6868 district with the largest population.
6969 Sec. 403.574. LIMITATION ON GRANT APPLICATIONS. A rural
7070 county law enforcement agency may apply for a grant under this
7171 subchapter not more than once each fiscal year of the county in
7272 which the agency is located.
7373 Sec. 403.575. APPROVAL OF COMMISSIONERS COURT REQUIRED.
7474 Before a rural law enforcement agency uses money received from a
7575 grant awarded under this subchapter for a purpose described by
7676 Section 403.572, the agency must obtain written approval to use the
7777 money for that purpose from the commissioners court of the county in
7878 which the agency is located. The commissioners court of a county
7979 may not reduce the amount of money provided to a rural county law
8080 enforcement agency because of grant funds provided under this
8181 subchapter to the rural county law enforcement agency.
8282 Sec. 403.576. DUTY TO RETURN UNSPENT GRANT MONEY. A rural
8383 county law enforcement agency that is awarded a grant under this
8484 subchapter shall return any unspent money awarded under that grant
8585 to the comptroller not later than the second anniversary of the date
8686 on which the money was disbursed to the agency.
8787 Sec. 403.577. REPORT. Not later than December 1 of each
8888 even-numbered year, the comptroller shall submit to the legislature
8989 a report on the results and performance of the grant program
9090 established under this subchapter.
9191 Sec. 403.578. RULES. The comptroller shall adopt rules to
9292 administer this subchapter, including rules that establish:
9393 (1) eligibility criteria for grant applicants;
9494 (2) grant application procedures;
9595 (3) guidelines relating to grant amounts;
9696 (4) procedures for evaluating grant applications; and
9797 (5) procedures for monitoring the use of a grant
9898 awarded under the program and ensuring compliance with any
9999 conditions of a grant.
100100 SECTION 2. This Act takes effect January 1, 2024.
