7 | 7 | | celebrating or providing special instruction regarding a sexual |

8 | 8 | | preference; authorizing a fine. |

9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Subchapter Z, Chapter 29, Education Code, is |
---|
11 | 11 | | amended by adding Section 29.936 to read as follows: |

12 | 12 | | Sec. 29.936. CELEBRATIONS AND PROGRAMS RELATING TO SEXUAL |
---|
13 | 13 | | PREFERENCE PROHIBITED. (a) A school district or open-enrollment |
---|
14 | 14 | | charter school shall not organize or host a program dedicated to |
---|
15 | 15 | | celebrating or providing special instruction regarding a sexual |
---|
16 | 16 | | preference. |
---|
17 | 17 | | (b) The State Board for Educator Certification shall impose |
---|
18 | 18 | | sanctions against a district or school employee who organizes or |
---|
19 | 19 | | hosts a program described by Subsection (a) in violation of this |
---|
20 | 20 | | section, including: |
---|
21 | 21 | | (1) a fine of not less than $500 and not more than |
---|
22 | 22 | | $10,000; |
---|
23 | 23 | | (2) termination or suspension of a teacher's permit; |
---|
24 | 24 | | or |
---|
25 | 25 | | (3) any other sanction that the State Board for |
---|
26 | 26 | | Educator Certification deems appropriate. |
---|
27 | 27 | | SECTION 2. This Act applies beginning with the 2023-2024 |
---|
28 | 28 | | school year. |
---|
29 | 29 | | SECTION 3. This Act takes effect immediately if it receives |
---|
30 | 30 | | a vote of two-thirds of all the members elected to each house, as |
---|
31 | 31 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
32 | 32 | | Act does not receive the vote necessary for immediate effect, this |
---|
33 | 33 | | Act takes effect September 1, 2023. |
