55 AN ACT
66 relating to prohibiting public school programs dedicated to
77 celebrating or providing special instruction regarding a sexual
88 preference; authorizing a fine.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter Z, Chapter 29, Education Code, is
1111 amended by adding Section 29.936 to read as follows:
1212 Sec. 29.936. CELEBRATIONS AND PROGRAMS RELATING TO SEXUAL
1313 PREFERENCE PROHIBITED. (a) A school district or open-enrollment
1414 charter school shall not organize or host a program dedicated to
1515 celebrating or providing special instruction regarding a sexual
1616 preference.
1717 (b) The State Board for Educator Certification shall impose
1818 sanctions against a district or school employee who organizes or
1919 hosts a program described by Subsection (a) in violation of this
2020 section, including:
2121 (1) a fine of not less than $500 and not more than
2222 $10,000;
2323 (2) termination or suspension of a teacher's permit;
2424 or
2525 (3) any other sanction that the State Board for
2626 Educator Certification deems appropriate.
2727 SECTION 2. This Act applies beginning with the 2023-2024
2828 school year.
2929 SECTION 3. This Act takes effect immediately if it receives
3030 a vote of two-thirds of all the members elected to each house, as
3131 provided by Section 39, Article III, Texas Constitution. If this
3232 Act does not receive the vote necessary for immediate effect, this
3333 Act takes effect September 1, 2023.
