| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Subchapter Z, Chapter 51, Education Code, is |
|---|
| 12 | 12 | | amended by adding Section 51.980 to read as follows: |
|---|
| 13 | 13 | | Sec. 51.980. ANNUAL REPORT ON FINANCIAL SUPPORT PROVIDED TO |
|---|
| 14 | 14 | | NONPROFIT MEDIA ORGANIZATIONS. (a) In this section: |
|---|
| 15 | 15 | | (1) "Coordinating board" means the Texas Higher |
|---|
| 16 | 16 | | Education Coordinating Board. |
|---|
| 17 | 17 | | (2) "Institution of higher education" has the meaning |
|---|
| 18 | 18 | | assigned by Section 61.003. |
|---|
| 19 | 19 | | (3) "Nonprofit media organization" means a media |
|---|
| 20 | 20 | | organization that is exempt from federal income tax under Section |
|---|
| 21 | 21 | | 501(a), Internal Revenue Code of 1986, by being listed as an exempt |
|---|
| 22 | 22 | | organization in Section 501(c)(3) of that code. |
|---|
| 23 | 23 | | (b) Not later than September 1 of each year, an institution |
|---|
| 24 | 24 | | of higher education shall submit to the coordinating board a report |
|---|
| 25 | 25 | | on financial support, including through the purchase of a |
|---|
| 26 | 26 | | membership, sponsorship, or advertising services, that the |
|---|
| 27 | 27 | | institution provided to a nonprofit media organization during the |
|---|
| 28 | 28 | | preceding state fiscal year. |
|---|
| 29 | 29 | | (c) A report submitted under Subsection (b) must include a |
|---|
| 30 | 30 | | list of all nonprofit media organizations that received financial |
|---|
| 31 | 31 | | support from the institution of higher education and the amount of |
|---|
| 32 | 32 | | financial support provided to each organization. |
|---|
| 33 | 33 | | (d) Not later than January 1 of each year, the coordinating |
|---|
| 34 | 34 | | board shall submit to the legislature a report on financial support |
|---|
| 35 | 35 | | provided to nonprofit media organizations by institutions of higher |
|---|
| 36 | 36 | | education during the preceding state fiscal year. The report must |
|---|
| 37 | 37 | | include a copy of each report submitted to the coordinating board |
|---|
| 38 | 38 | | under Subsection (b) for the preceding state fiscal year. |
|---|
| 39 | 39 | | (e) The coordinating board may adopt rules as necessary to |
|---|
| 40 | 40 | | implement this section. |
|---|
| 41 | 41 | | SECTION 2. (a) Not later than September 1, 2023, each |
|---|
| 42 | 42 | | public institution of higher education shall submit its initial |
|---|
| 43 | 43 | | report required under Section 51.980(b), Education Code, as added |
|---|
| 44 | 44 | | by this Act. |
|---|
| 45 | 45 | | (b) Not later than January 1, 2024, the Texas Higher |
|---|
| 46 | 46 | | Education Coordinating Board shall submit its initial report |
|---|
| 47 | 47 | | required under Section 51.980(d), Education Code, as added by this |
|---|
| 48 | 48 | | Act. |
|---|
| 49 | 49 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 50 | 50 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 51 | 51 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 52 | 52 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 53 | 53 | | Act takes effect September 1, 2023. |
