55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to certain affirmative defenses to prosecution for the
88 criminal offenses of sexual performance by a child and possession
99 or promotion of child pornography.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 43.25(f), Penal Code, is amended to read
1212 as follows:
1313 (f) It is an affirmative defense to a prosecution under this
1414 section that[:
1515 [(1)] the defendant was the spouse of the child at the
1616 time of the offense[;
1717 [(2) the conduct was for a bona fide educational,
1818 medical, psychological, psychiatric, judicial, law enforcement, or
1919 legislative purpose; or
2020 [(3) the defendant is not more than two years older
2121 than the child].
2222 SECTION 2. Section 43.26(c), Penal Code, is amended to read
2323 as follows:
2424 (c) It is an [The] affirmative defense [defenses provided by
2525 Section 43.25(f) also apply] to a prosecution under this section
2626 that:
2727 (1) the defendant was the spouse of the child at the
2828 time of the offense; or
2929 (2) the conduct was for a bona fide judicial or law
3030 enforcement purpose.
3131 SECTION 3. The changes in law made by this Act apply only to
3232 an offense committed on or after the effective date of this Act. An
3333 offense committed before the effective date of this Act is governed
3434 by the law in effect on the date the offense was committed, and the
3535 former law is continued in effect for that purpose. For purposes of
3636 this section, an offense was committed before the effective date of
3737 this Act if any element of the offense occurred before that date.
3838 SECTION 4. This Act takes effect September 1, 2023.
