| 7 | 7 | | relating to certain affirmative defenses to prosecution for the |

| 8 | 8 | | criminal offenses of sexual performance by a child and possession |
|---|
| 9 | 9 | | or promotion of child pornography. |
|---|
| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 43.25(f), Penal Code, is amended to read |
|---|
| 12 | 12 | | as follows: |
|---|
| 13 | 13 | | (f) It is an affirmative defense to a prosecution under this |
|---|
| 14 | 14 | | section that[: |
|---|
| 15 | 15 | | [(1)] the defendant was the spouse of the child at the |
|---|
| 16 | 16 | | time of the offense[; |
|---|
| 17 | 17 | | [(2) the conduct was for a bona fide educational, |
|---|
| 18 | 18 | | medical, psychological, psychiatric, judicial, law enforcement, or |
|---|
| 19 | 19 | | legislative purpose; or |
|---|
| 20 | 20 | | [(3) the defendant is not more than two years older |
|---|
| 21 | 21 | | than the child]. |

| 22 | 22 | | SECTION 2. Section 43.26(c), Penal Code, is amended to read |
|---|
| 23 | 23 | | as follows: |
|---|
| 24 | 24 | | (c) It is an [The] affirmative defense [defenses provided by |
|---|
| 25 | 25 | | Section 43.25(f) also apply] to a prosecution under this section |
|---|
| 26 | 26 | | that: |
|---|
| 27 | 27 | | (1) the defendant was the spouse of the child at the |
|---|
| 28 | 28 | | time of the offense; or |
|---|
| 29 | 29 | | (2) the conduct was for a bona fide judicial or law |
|---|
| 30 | 30 | | enforcement purpose. |

| 31 | 31 | | SECTION 3. The changes in law made by this Act apply only to |
|---|
| 32 | 32 | | an offense committed on or after the effective date of this Act. An |
|---|
| 33 | 33 | | offense committed before the effective date of this Act is governed |
|---|
| 34 | 34 | | by the law in effect on the date the offense was committed, and the |
|---|
| 35 | 35 | | former law is continued in effect for that purpose. For purposes of |
|---|
| 36 | 36 | | this section, an offense was committed before the effective date of |
|---|
| 37 | 37 | | this Act if any element of the offense occurred before that date. |
|---|
| 38 | 38 | | SECTION 4. This Act takes effect September 1, 2023. |
