| 7 | 7 | | relating to protesting changes to municipal zoning regulations and |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 211.006(d), Local Government Code, is |
|---|
| 11 | 11 | | amended to read as follows: |
|---|
| 12 | 12 | | (d) If a proposed change to a regulation or boundary is |
|---|
| 13 | 13 | | protested in accordance with this subsection, the proposed change |
|---|
| 14 | 14 | | must receive, in order to take effect, the affirmative vote of at |
|---|
| 15 | 15 | | least three-fourths of all members of the governing body. The |
|---|
| 16 | 16 | | protest must be written and signed by the owners of at least 50 [20] |
|---|
| 17 | 17 | | percent of either: |
|---|
| 18 | 18 | | (1) the area of the lots or land covered by the |
|---|
| 19 | 19 | | proposed change; or |
|---|
| 20 | 20 | | (2) the area of the lots or land immediately adjoining |
|---|
| 21 | 21 | | the area covered by the proposed change and extending 200 feet from |
|---|
| 22 | 22 | | that area. |
|---|
| 23 | 23 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 24 | 24 | | to a proposal to change a municipal zoning regulation or zoning |
|---|
| 25 | 25 | | district boundary made on or after the effective date of this Act. |
|---|
| 26 | 26 | | A proposal to change a municipal zoning regulation or zoning |
|---|
| 27 | 27 | | district boundary made before the effective date of this Act is |
|---|
| 28 | 28 | | governed by the law in effect on the date the proposal was made, and |
|---|
| 29 | 29 | | the former law is continued in effect for that purpose. |
|---|
| 30 | 30 | | SECTION 3. This Act takes effect September 1, 2023. |
