55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to protesting changes to municipal zoning regulations and
88 boundaries.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 211.006(d), Local Government Code, is
1111 amended to read as follows:
1212 (d) If a proposed change to a regulation or boundary is
1313 protested in accordance with this subsection, the proposed change
1414 must receive, in order to take effect, the affirmative vote of at
1515 least three-fourths of all members of the governing body. The
1616 protest must be written and signed by the owners of at least 50 [20]
1717 percent of either:
1818 (1) the area of the lots or land covered by the
1919 proposed change; or
2020 (2) the area of the lots or land immediately adjoining
2121 the area covered by the proposed change and extending 200 feet from
2222 that area.
2323 SECTION 2. The change in law made by this Act applies only
2424 to a proposal to change a municipal zoning regulation or zoning
2525 district boundary made on or after the effective date of this Act.
2626 A proposal to change a municipal zoning regulation or zoning
2727 district boundary made before the effective date of this Act is
2828 governed by the law in effect on the date the proposal was made, and
2929 the former law is continued in effect for that purpose.
3030 SECTION 3. This Act takes effect September 1, 2023.
