| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Subchapter I, Chapter 545, Transportation Code, |
|---|
| 13 | 13 | | is amended by adding Section 545.4146 to read as follows: |
|---|
| 14 | 14 | | Sec. 545.4146. TRANSPORTING DOGS IN OPEN BEDS. (a) This |
|---|
| 15 | 15 | | section applies only to a vehicle being operated or a trailer being |
|---|
| 16 | 16 | | drawn: |
|---|
| 17 | 17 | | (1) in a county with a population of more than 500,000; |
|---|
| 18 | 18 | | and |
|---|
| 19 | 19 | | (2) on a freeway with a speed limit of 60 miles per |
|---|
| 20 | 20 | | hour or more. |
|---|
| 21 | 21 | | (b) A person may not operate an open-bed pickup truck or an |
|---|
| 22 | 22 | | open flatbed truck or draw an open flatbed trailer described by |
|---|
| 23 | 23 | | Subsection (a) when a dog is occupying the bed of the truck or |
|---|
| 24 | 24 | | trailer unless: |
|---|
| 25 | 25 | | (1) the dog occupying the bed of the truck or trailer |
|---|
| 26 | 26 | | is secured in a crate, cage, or other closed container; and |
|---|
| 27 | 27 | | (2) the container required by Subdivision (1) is |
|---|
| 28 | 28 | | securely attached to the walls or bed of the truck or trailer. |
|---|
| 29 | 29 | | SECTION 2. This Act takes effect September 1, 2023. |
