| 7 | 7 | | relating to the provision of information regarding certain public |

| 8 | 8 | | assistance programs by public schools. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter A, Chapter 38, Education Code, is |
|---|
| 11 | 11 | | amended by adding Section 38.039 to read as follows: |
|---|
| 12 | 12 | | Sec. 38.039. INFORMATION REGARDING CERTAIN PUBLIC |
|---|
| 13 | 13 | | ASSISTANCE PROGRAMS. (a) On a student's enrollment in, transfer |
|---|
| 14 | 14 | | out of, or withdrawal from a school district, the district shall |
|---|
| 15 | 15 | | provide to the student and the student's parent information |
|---|
| 16 | 16 | | regarding the eligibility requirements for public assistance |
|---|
| 17 | 17 | | programs, including: |
|---|
| 18 | 18 | | (1) the medical assistance program under Chapter 32, |
|---|
| 19 | 19 | | Human Resources Code; |
|---|
| 20 | 20 | | (2) the child health plan program under Chapter 62, |
|---|
| 21 | 21 | | Health and Safety Code; and |
|---|
| 22 | 22 | | (3) the supplemental nutrition assistance program |
|---|
| 23 | 23 | | under Chapter 33, Human Resources Code. |
|---|
| 24 | 24 | | (b) The agency, in coordination with the Health and Human |
|---|
| 25 | 25 | | Services Commission, shall prepare and make available to school |
|---|
| 26 | 26 | | districts a model form for the information required to be provided |
|---|
| 27 | 27 | | under Subsection (a). |
|---|
| 28 | 28 | | (c) In providing the information required under Subsection |
|---|
| 29 | 29 | | (a), the school district shall ensure that the student's parent |
|---|
| 30 | 30 | | signs a form acknowledging receipt of the information. |
|---|
| 31 | 31 | | SECTION 2. This Act applies beginning with the 2023-2024 |
|---|
| 32 | 32 | | school year. |
|---|
| 33 | 33 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 34 | 34 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 35 | 35 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 36 | 36 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 37 | 37 | | Act takes effect September 1, 2023. |
