55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the provision of information regarding certain public
88 assistance programs by public schools.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter A, Chapter 38, Education Code, is
1111 amended by adding Section 38.039 to read as follows:
1212 Sec. 38.039. INFORMATION REGARDING CERTAIN PUBLIC
1313 ASSISTANCE PROGRAMS. (a) On a student's enrollment in, transfer
1414 out of, or withdrawal from a school district, the district shall
1515 provide to the student and the student's parent information
1616 regarding the eligibility requirements for public assistance
1717 programs, including:
1818 (1) the medical assistance program under Chapter 32,
1919 Human Resources Code;
2020 (2) the child health plan program under Chapter 62,
2121 Health and Safety Code; and
2222 (3) the supplemental nutrition assistance program
2323 under Chapter 33, Human Resources Code.
2424 (b) The agency, in coordination with the Health and Human
2525 Services Commission, shall prepare and make available to school
2626 districts a model form for the information required to be provided
2727 under Subsection (a).
2828 (c) In providing the information required under Subsection
2929 (a), the school district shall ensure that the student's parent
3030 signs a form acknowledging receipt of the information.
3131 SECTION 2. This Act applies beginning with the 2023-2024
3232 school year.
3333 SECTION 3. This Act takes effect immediately if it receives
3434 a vote of two-thirds of all the members elected to each house, as
3535 provided by Section 39, Article III, Texas Constitution. If this
3636 Act does not receive the vote necessary for immediate effect, this
3737 Act takes effect September 1, 2023.
