77 relating to recognizing persons who separated from military service
88 solely on the basis of sexual orientation as honorably discharged
99 veterans under state law.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Chapter 434, Government Code, is amended by
1212 adding Subchapter J to read as follows:
1313 SUBCHAPTER J. BENEFITS, RIGHTS, PRIVILEGES, AND IMMUNITIES OF
1414 CERTAIN VETERANS
1515 Sec. 434.451. DEFINITIONS. In this subchapter:
1616 (1) "Active military service" has the meaning assigned
1717 by Section 437.001.
1818 (2) "DD Form 214" means any edition of United States
1919 Department of Defense Form 214 (Certificate of Release or Discharge
2020 from Active Duty).
2121 (3) "Military discharge record" means a document
2222 issued to a service member of the armed forces of the United States
2323 or the Texas Military Forces showing the service member's release
2424 or discharge from active military service. The term includes DD
2525 Form 214.
2626 (4) "Separation code" means:
2727 (A) an alphanumeric code found in block 26 of the
2828 edition of DD Form 214 dated August 2009; or
2929 (B) a numeric code commonly known as a separation
3030 program code used on a previous edition of DD Form 214.
3131 Sec. 434.452. CERTAIN PERSONS CONSIDERED HONORABLY
3232 DISCHARGED. (a) The State of Texas recognizes a person as having
3333 been honorably discharged from active military service if:
3434 (1) according to the person's military discharge
3535 record, the person on the basis of the person's sexual orientation:
3636 (A) was dishonorably discharged; or
3737 (B) resigned, retired, or otherwise separated
3838 from active military service; and
3939 (2) based on any previous characterization of service,
4040 the person would have otherwise received a more favorable character
4141 of discharge.
4242 (b) For purposes of Subsection (a)(1), a person is
4343 considered to have been dishonorably discharged or to have
4444 resigned, retired, or otherwise separated from active military
4545 service on the basis of the person's sexual orientation if:
4646 (1) any of the following separation codes appear on
4747 the person's DD Form 214 and represent a ground on which the person
4848 was released or discharged from the armed forces of the United
4949 States:
5050 (A) BLC;
5151 (B) BML;
5252 (C) BRA;
5353 (D) BRB;
5454 (E) BRC;
5555 (F) DLC;
5656 (G) GKC;
5757 (H) GLC;
5858 (I) GML;
5959 (J) GRA;
6060 (K) GRB;
6161 (L) GRC;
6262 (M) HLC;
6363 (N) HRA;
6464 (O) HRB;
6565 (P) HRC;
6666 (Q) HWL;
6767 (R) JB;
6868 (S) JJB;
6969 (T) JKC;
7070 (U) JLC;
7171 (V) JML;
7272 (W) JRA;
7373 (X) JRB;
7474 (Y) JRC;
7575 (Z) KRA;
7676 (AA) KRB;
7777 (BB) KRC;
7878 (CC) RA;
7979 (DD) RC;
8080 (EE) 249;
8181 (FF) 250;

8989 (2) any other ground for release or discharge from
9090 active military service based on sexual orientation, including a
9191 predecessor or successor to a separation code listed in Subdivision
9292 (1), appears on the person's military discharge record.
9393 Sec. 434.453. ENTITLEMENT TO BENEFITS, RIGHTS, PRIVILEGES,
9494 AND IMMUNITIES. Notwithstanding any other law, a person recognized
9595 as having been honorably discharged under Section 434.452(a) is
9696 entitled to all benefits, rights, privileges, and immunities
9797 provided by this state or under state law to an honorably discharged
9898 veteran.
9999 Sec. 434.454. PROOF OF CERTAIN DISCHARGE. For purposes of
100100 this subchapter, an agency or officer of this state shall accept a
101101 copy of a person's DD Form 214 identified or commonly known as
102102 "Service 2 Copy" or "Member 4 Copy."
103103 SECTION 2. This Act takes effect September 1, 2023.
