66 AN ACT
77 relating to program accessibility for female inmates of the Texas
88 Department of Criminal Justice.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 501.027, Government Code, is amended to
1111 read as follows:
1212 Sec. 501.027. ACCESS TO PROGRAMS BY FEMALE INMATES. (a)
1313 The department shall develop and implement policies that increase
1414 and promote a female inmate's access to programs, including
1515 self-study programs on parenting, healing from trauma, and
1616 financial literacy, offered to inmates in the custody of the
1717 department, including programs offered to defendants confined in
1818 state jail felony facilities [including educational, vocational,
1919 substance use treatment, rehabilitation, life skills training, and
2020 prerelease programs]. The department may not reduce or limit a male
2121 inmate's access to a program to meet the requirements of this
2222 section.
2323 (b) The department shall develop and implement policies
2424 that:
2525 (1) require each facility to make the programs
2626 described by Subsection (a) available and accessible to a female
2727 inmate not later than the 45th day after the date the inmate arrives
2828 at the facility; and
2929 (2) ensure female inmates have the ability to
3030 participate in the self-study programs described by Subsection (a),
3131 regardless of the inmate's offense, sentence, mental health record,
3232 or behavior while confined.
3333 (c) Not later than December 31 of each year, the department
3434 shall:
3535 (1) prepare and submit to the governor, the lieutenant
3636 governor, the speaker of the house of representatives, each
3737 standing committee of the legislature having primary jurisdiction
3838 over the department, and the reentry task force described by
3939 Section 501.098 a written report that includes:
4040 (A) a description of any department policies that
4141 were created, modified, or eliminated during the preceding year to
4242 meet the requirements of this section; and
4343 (B) a list of programs, including self-study
4444 programs, available to female inmates in the custody of the
4545 department during the preceding year; and
4646 (2) publish the report on the department's Internet
4747 website.
4848 SECTION 2. As soon as practicable after the effective date
4949 of this Act, the Texas Department of Criminal Justice shall develop
5050 and implement the policies necessary to implement the changes in
5151 law made by this Act.
5252 SECTION 3. This Act takes effect September 1, 2023.
