66 AN ACT
77 relating to a statewide standing order prescribing opioid
88 antagonists.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 483.102, Health and Safety Code, is
1111 amended by adding Subsections (a-1) and (d) to read as follows:
1212 (a-1) The commissioner of state health services or, if the
1313 commissioner is not a physician, the chief medical executive of the
1414 Department of State Health Services shall issue a statewide
1515 standing order prescribing an opioid antagonist to a person
1616 described by Subsection (a)(1) or (2).
1717 (d) The commissioner or the chief medical executive who
1818 prescribes an opioid antagonist under a standing order as required
1919 under Subsection (a-1) has official immunity and may not be subject
2020 to any criminal or civil liability for:
2121 (1) issuing the standing order prescribing the opioid
2222 antagonist; or
2323 (2) any outcome resulting from the eventual
2424 administration of the opioid antagonist.
2525 SECTION 2. This Act takes effect immediately if it receives
2626 a vote of two-thirds of all the members elected to each house, as
2727 provided by Section 39, Article III, Texas Constitution. If this
2828 Act does not receive the vote necessary for immediate effect, this
2929 Act takes effect September 1, 2023.
