55 relating to the functions of the Texas Water Development Board and
66 continuation and functions of the State Water Implementation Fund

88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 6.013, Water Code, is amended to read as
1010 follows:
1111 Sec. 6.013. SUNSET PROVISION. The Texas Water Development
1212 Board is subject to review under Chapter 325, Government Code
1313 (Texas Sunset Act), but is not abolished under that chapter. The
1414 board shall be reviewed during the period in which state agencies
1515 abolished in 2035 [2023] and every 12th year after 2035 [2023] are
1616 reviewed.
1717 SECTION 2. Section 6.062, Water Code, is amended by
1818 amending Subsection (b) and adding Subsection (d) to read as
1919 follows:
2020 (b) The training program must provide the person with
2121 information regarding:
2222 (1) the law governing [legislation that created the]
2323 board operations;
2424 (2) the programs, functions, rules, and budget of
2525 [operated by] the board;
2626 (3) the scope of and limitations on the rulemaking
2727 authority [role and functions] of the board;
2828 (4) [the rules of the board, with an emphasis on the
2929 rules that relate to disciplinary and investigatory authority;
3030 [(5) the current budget for the board;
3131 [(6)] the results of the most recent formal audit of
3232 the board;
3333 (5) [(7)] the requirements of:
3434 (A) laws relating to [the] open meetings, [law,
3535 Chapter 551, Government Code;
3636 [(B) the] public information, [law, Chapter 552,
3737 Government Code;
3838 [(C) the] administrative procedure, [law,
3939 Chapter 2001, Government Code;] and disclosing conflicts of
4040 interest; and
4141 (B) [(D)] other laws applicable to members of a
4242 state policy-making body in performing their duties [relating to
4343 public officials, including conflict of interest laws]; and
4444 (6) [(8)] any applicable ethics policies adopted by
4545 the board or the Texas Ethics Commission.
4646 (d) The executive administrator shall create a training
4747 manual that includes the information required by Subsection (b).
4848 The executive administrator shall distribute a copy of the training
4949 manual annually to each member of the board. Each member of the
5050 board shall sign and submit to the executive administrator a
5151 statement acknowledging that the member received and reviewed the
5252 training manual.
5353 SECTION 3. Section 15.438(k), Water Code, is amended to
5454 read as follows:
5555 (k) The advisory committee is subject to Chapter 325,
5656 Government Code (Texas Sunset Act). Unless continued in existence
5757 as provided by that chapter, the advisory committee is abolished
5858 and this section expires September 1, 2035 [2023].
5959 SECTION 4. Section 16.053, Water Code, is amended by
6060 amending Subsection (e) and adding Subsection (e-2) to read as
6161 follows:
6262 (e) Each regional water planning group shall submit to the
6363 development board a regional water plan that:
6464 (1) is consistent with the guidance principles for the
6565 state water plan adopted by the development board under Section
6666 16.051(d);
6767 (2) provides information based on data provided or
6868 approved by the development board in a format consistent with the
6969 guidelines provided by the development board under Subsection (d);
7070 (2-a) is consistent with the desired future conditions
7171 adopted under Section 36.108 for the relevant aquifers located in
7272 the regional water planning area as of the most recent deadline for
7373 the board to adopt the state water plan under Section 16.051 or, at
7474 the option of the regional water planning group, established
7575 subsequent to the adoption of the most recent plan; provided,
7676 however, that if no groundwater conservation district exists within
7777 the area of the regional water planning group, the regional water
7878 planning group shall determine the supply of groundwater for
7979 regional planning purposes; the Texas Water Development Board shall
8080 review and approve, prior to inclusion in the regional water plan,
8181 that the groundwater supply for the regional planning group without
8282 a groundwater conservation district in its area is physically
8383 compatible, using the board's groundwater availability models,
8484 with the desired future conditions adopted under Section 36.108 for
8585 the relevant aquifers in the groundwater management area that are
8686 regulated by groundwater conservation districts;
8787 (3) identifies:
8888 (A) each source of water supply in the regional
8989 water planning area, including information supplied by the
9090 executive administrator on the amount of modeled available
9191 groundwater in accordance with the guidelines provided by the
9292 development board under Subsections (d) and (f);
9393 (B) factors specific to each source of water
9494 supply to be considered in determining whether to initiate a
9595 drought response;
9696 (C) actions to be taken as part of the response;
9797 (D) existing major water infrastructure
9898 facilities that may be used for interconnections in the event of an
9999 emergency shortage of water; and
100100 (E) unnecessary or counterproductive variations
101101 in specific drought response strategies, including outdoor
102102 watering restrictions, among user groups in the regional water
103103 planning area that may confuse the public or otherwise impede
104104 drought response efforts;
105105 (4) has specific provisions for water management
106106 strategies to be used during a drought of record;
107107 (5) includes but is not limited to consideration of
108108 the following:
109109 (A) any existing water or drought planning
110110 efforts addressing all or a portion of the region and potential
111111 impacts on public health, safety, or welfare in this state;
112112 (B) approved groundwater conservation district
113113 management plans and other plans submitted under Section 16.054;
114114 (C) all potentially feasible water management
115115 strategies, including but not limited to improved conservation,
116116 reuse, and management of existing water supplies, conjunctive use,
117117 acquisition of available existing water supplies, and development
118118 of new water supplies;
119119 (D) protection of existing water rights in the
120120 region;
121121 (E) opportunities for and the benefits of
122122 developing regional water supply facilities or providing regional
123123 management of water supply facilities;
124124 (F) appropriate provision for environmental
125125 water needs and for the effect of upstream development on the bays,
126126 estuaries, and arms of the Gulf of Mexico and the effect of plans on
127127 navigation;
128128 (G) provisions in Section 11.085(k)(1) if
129129 interbasin transfers are contemplated;
130130 (H) voluntary transfer of water within the region
131131 using, but not limited to, regional water banks, sales, leases,
132132 options, subordination agreements, and financing agreements;
133133 (I) emergency transfer of water under Section
134134 11.139, including information on the part of each permit, certified
135135 filing, or certificate of adjudication for nonmunicipal use in the
136136 region that may be transferred without causing unreasonable damage
137137 to the property of the nonmunicipal water rights holder; and
138138 (J) opportunities for and the benefits of
139139 developing large-scale desalination facilities for:
140140 (i) marine seawater that serve local or
141141 regional entities; and
142142 (ii) brackish groundwater that serve local
143143 or regional brackish groundwater production zones identified and
144144 designated under Section 16.060(b)(5);
145145 (6) identifies river and stream segments of unique
146146 ecological value and sites of unique value for the construction of
147147 reservoirs that the regional water planning group recommends for
148148 protection under Section 16.051;
149149 (7) assesses the impact of the plan on unique river and
150150 stream segments identified in Subdivision (6) if the regional water
151151 planning group or the legislature determines that a site of unique
152152 ecological value exists;
153153 (8) describes the impact of proposed water projects on
154154 water quality;
155155 (9) includes information on:
156156 (A) projected water use and conservation in the
157157 regional water planning area; [and]
158158 (B) the implementation of state and regional
159159 water plan projects, including water conservation strategies,
160160 necessary to meet the state's projected water demands; and
161161 (C) the implementation of large projects,
162162 including reservoirs, interstate water transfers, innovative
163163 technology projects, desalination plants, and other large projects
164164 as determined by the board, including information regarding:
165165 (i) expenditures of sponsor money;
166166 (ii) permit applications, including the
167167 status of a permit application; and
168168 (iii) status updates on the phase of
169169 construction of a project;
170170 (10) if the regional water planning area has
171171 significant identified water needs, provides a specific assessment
172172 of the potential for aquifer storage and recovery projects to meet
173173 those needs;
174174 (11) sets one or more specific goals for gallons of
175175 water use per capita per day in each decade of the period covered by
176176 the plan for the municipal water user groups in the regional water
177177 planning area; and
178178 (12) assesses the progress of the regional water
179179 planning area in encouraging cooperation between water user groups
180180 for the purpose of achieving economies of scale and otherwise
181181 incentivizing strategies that benefit the entire region.
182182 (e-2) A regional water planning group may plan for drought
183183 conditions worse than the drought of record when developing a
184184 regional water plan under Subsection (e).
185185 SECTION 5. Subchapter E, Chapter 16, Water Code, is amended
186186 by adding Section 16.147 to read as follows:
187187 Sec. 16.147. ESTABLISHMENT OF CERTAIN PERFORMANCE GOALS AND
188188 METRICS. (a) The board shall develop and implement performance
189189 goals and performance metrics as part of a comprehensive evaluation
190190 of the board's review of proposed projects for compliance with
191191 programmatic and design requirements.
192192 (b) The board shall periodically:
193193 (1) collect data regarding the performance metrics;
194194 (2) analyze the data described by Subdivision (1)
195195 related to the performance metrics to identify relevant trends; and
196196 (3) use the performance metrics to assess the board's
197197 progress toward meeting the board's performance goals.
198198 (c) The board shall periodically review the performance
199199 goals and performance metrics to assess the effectiveness and
200200 efficiency of the board's review of proposed projects.
201201 (d) The executive administrator shall periodically update
202202 the board on the implementation and analysis of the performance
203203 metrics and progress toward performance goals.
204204 (e) The board shall develop and implement periodic
205205 reporting schedules for all performance goals and performance
206206 metrics required under this section.
207207 SECTION 6. Section 17.276, Water Code, is amended by adding
208208 Subsections (d-1), (d-2), and (d-3) to read as follows:
209209 (d-1) The board by rule may adopt procedures allowing the
210210 use of different standards of review and approval of design
211211 criteria for plans and specifications for sewage collection,
212212 treatment, and disposal systems.
213213 (d-2) In establishing the appropriate standard of review
214214 and approval for plans and specifications under Subsection (d-1),
215215 the rules must require an individualized assessment that applies
216216 risk-based considerations to each project associated with the plans
217217 and specifications, including:
218218 (1) any potential financial risk associated with the
219219 project;
220220 (2) any risk to public health associated with the
221221 project; or
222222 (3) other relevant financial considerations
223223 associated with the project.
224224 (d-3) For plans and specifications subject to a limited
225225 standard of review and approval under Subsection (d-1), the board
226226 shall require the registered professional engineer who submitted
227227 the plans and specifications to make a finding that:
228228 (1) the plans and specifications are in substantial
229229 compliance with standards established by the commission; and
230230 (2) any deviation from the standards established by
231231 the commission is based on the best professional judgment of the
232232 registered professional engineer.
233233 SECTION 7. The following provisions of the Water Code are
234234 repealed:
235235 (1) Section 15.108;
236236 (2) Section 15.218; and
237237 (3) Section 15.3061.
238238 SECTION 8. (a) Except as provided by Subsection (b) of this
239239 section, Section 6.062, Water Code, as amended by this Act, applies
240240 to a member of the Texas Water Development Board appointed before,
241241 on, or after the effective date of this Act.
242242 (b) A member of the Texas Water Development Board who,
243243 before the effective date of this Act, completed the training
244244 program required by Section 6.062, Water Code, as that law existed
245245 before the effective date of this Act, is only required to complete
246246 additional training on the subjects added by this Act to the
247247 training program required by Section 6.062, Water Code. A board
248248 member described by this subsection may not vote, deliberate, or be
249249 counted as a member in attendance at a meeting of the board held on
250250 or after December 1, 2023, until the member completes the
251251 additional training.
252252 SECTION 9. This Act takes effect September 1, 2023.
