| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 12.106(d), Education Code, is amended to |
|---|
| 11 | 11 | | read as follows: |
|---|
| 12 | 12 | | (d) Subject to Subsection (e), in addition to other amounts |
|---|
| 13 | 13 | | provided by this section, a charter holder is entitled to receive, |
|---|
| 14 | 14 | | for the open-enrollment charter school, funding per student in |
|---|
| 15 | 15 | | average daily attendance in an amount equal to the guaranteed level |
|---|
| 16 | 16 | | of state and local funds per student per cent of tax effort under |
|---|
| 17 | 17 | | Section 46.032(a) multiplied by [the lesser of: |
|---|
| 18 | 18 | | [(1)] the state average interest and sinking fund tax |
|---|
| 19 | 19 | | rate imposed by school districts for the current year[; or |
|---|
| 20 | 20 | | [(2) a rate that would result in a total amount to |
|---|
| 21 | 21 | | which charter schools are entitled under this subsection for the |
|---|
| 22 | 22 | | current year equal to $60 million]. |

| 23 | 23 | | SECTION 2. This Act takes effect September 1, 2023. |
