55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to a health literacy plan developed by the statewide
88 health coordinating council and the inclusion of health literacy in
99 the state health plan.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 104.002, Health and Safety Code, is
1212 amended by adding Subdivision (6) to read as follows:
1313 (6) "Health literacy" means the degree to which an
1414 individual has the capacity to find, understand, and use health
1515 information and services to inform health-related decisions and
1616 actions.
1717 SECTION 2. Subchapter B, Chapter 104, Health and Safety
1818 Code, is amended by adding Section 104.0156 to read as follows:
1919 Sec. 104.0156. HEALTH LITERACY PLAN. (a) The statewide
2020 health coordinating council shall develop a long-range plan for
2121 improving health literacy in this state. The council shall update
2222 the plan at least once every two years.
2323 (b) In developing the long-range plan, the statewide health
2424 coordinating council shall study the economic impact of low health
2525 literacy on state health programs and health insurance coverage for
2626 state residents. The council shall:
2727 (1) identify primary risk factors contributing to low
2828 health literacy;
2929 (2) examine methods for health care practitioners,
3030 health care facilities, and other persons to address the health
3131 literacy of patients and other health care consumers;
3232 (3) examine the effectiveness of using quality
3333 measures in state health programs to improve health literacy;
3434 (4) identify strategies for expanding the use of plain
3535 language instructions for patients; and
3636 (5) examine the impact of improved health literacy on
3737 enhancing patient safety, reducing preventable events, and
3838 increasing medication adherence to attain greater
3939 cost-effectiveness and better patient outcomes in the provision of
4040 health care.
4141 (c) Not later than November 1 of each even-numbered year,
4242 the statewide health coordinating council shall submit the
4343 long-range plan developed or updated under this section to the
4444 governor, the lieutenant governor, the speaker of the house of
4545 representatives, and each member of the legislature.
4646 SECTION 3. Sections 104.022(e) and (f), Health and Safety
4747 Code, are amended to read as follows:
4848 (e) The state health plan shall be developed and used in
4949 accordance with applicable state and federal law. The plan must
5050 identify:
5151 (1) major statewide health concerns, including the
5252 prevalence of low health literacy among health care consumers;
5353 (2) the availability and use of current health
5454 resources of the state, including resources associated with
5555 information technology and state-supported institutions of higher
5656 education; and
5757 (3) future health service, information technology,
5858 and facility needs of the state.
5959 (f) The state health plan must:
6060 (1) propose strategies for the correction of major
6161 deficiencies in the service delivery system;
6262 (2) propose strategies for improving health literacy
6363 to attain greater cost-effectiveness and better patient outcomes in
6464 the provision of health care;
6565 (3) [(2)] propose strategies for incorporating
6666 information technology in the service delivery system;
6767 (4) [(3)] propose strategies for involving
6868 state-supported institutions of higher education in providing
6969 health services and for coordinating those efforts with health and
7070 human services agencies in order to close gaps in services; and
7171 (5) [(4)] provide direction for the state's
7272 legislative and executive decision-making processes to implement
7373 the strategies proposed by the plan.
7474 SECTION 4. This Act takes effect September 1, 2023.
