66 AN ACT
77 relating to the investigation of municipal fire fighters in certain
88 municipalities.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 614.021(b), Government Code, is amended
1111 to read as follows:
1212 (b) Except as provided by Section 614.024, this [This]
1313 subchapter does not apply to a peace officer or fire fighter
1414 appointed or employed by a political subdivision that is covered by
1515 a meet and confer or collective bargaining agreement under Chapter
1616 143 or 174, Local Government Code, if that agreement includes
1717 provisions relating to the investigation of, and disciplinary
1818 action resulting from, a complaint against a peace officer or fire
1919 fighter, as applicable.
2020 SECTION 2. Section 614.023(a), Government Code, is amended
2121 to read as follows:
2222 (a) A copy of a signed complaint against a law enforcement
2323 officer of this state or a fire fighter, detention officer, county
2424 jailer, or peace officer appointed or employed by a political
2525 subdivision of this state shall be given to the officer or employee:
2626 (1) within a reasonable time after the complaint is
2727 filed; or
2828 (2) for a municipal fire fighter, in accordance with
2929 procedures applicable under Section 614.024.
3030 SECTION 3. Subchapter B, Chapter 614, Government Code, is
3131 amended by adding Section 614.024 to read as follows:
3232 Sec. 614.024. INVESTIGATION OF MUNICIPAL FIRE FIGHTERS
3333 REQUIRED IN CERTAIN MUNICIPALITIES. (a) In this section:
3434 (1) "Fire fighter" means a paid employee of a
3535 municipal fire department.
3636 (2) "Investigation" means an administrative
3737 investigation conducted by a municipality of alleged misconduct by
3838 a fire fighter that could result in punitive action against the fire
3939 fighter.
4040 (3) "Punitive action" means a disciplinary
4141 suspension, indefinite suspension, demotion in rank, reprimand, or
4242 any combination of those actions.
4343 (b) This section applies only to a municipality with a
4444 population of 10,000 or more.
4545 (c) Notwithstanding Section 614.021(b), this section
4646 applies to a fire fighter employed by a municipality regardless of
4747 whether the municipality is covered by a meet and confer or
4848 collective bargaining agreement under Chapter 143 or 174, Local
4949 Government Code.
5050 (d) This section supersedes a conflicting provision in a
5151 meet and confer or collective bargaining agreement.
5252 (e) A meet and confer or collective bargaining agreement
5353 under Chapter 143 or 174, Local Government Code, may impose
5454 requirements for investigations in addition to those provided in
5555 Section 143.123 or Sections 143.312(a)-(k), Local Government Code,
5656 that do not conflict with the requirements of those sections.
5757 (f) In addition to the requirements of Section 614.023, a
5858 municipality may not take punitive action against a fire fighter
5959 unless an investigation has been conducted in accordance with:
6060 (1) Section 143.123 or Sections 143.312(a)-(k), Local
6161 Government Code, or other applicable law, including the
6262 requirements adopted under Subsection (g), if applicable; and
6363 (2) any additional requirements imposed by a meet and
6464 confer or collective bargaining agreement under Chapter 143 or 174,
6565 Local Government Code.
6666 (g) A municipality to which Section 143.123 or 143.312,
6767 Local Government Code, or another substantially similar
6868 investigation requirement does not apply shall adopt and comply
6969 with:
7070 (1) procedures substantially identical to those
7171 required by Sections 143.312(a)-(k), Local Government Code; and
7272 (2) any additional procedures or requirements imposed
7373 by a meet and confer or collective bargaining agreement under
7474 Chapter 143 or 174, Local Government Code.
7575 SECTION 4. (a) Section 614.024, Government Code, as added
7676 by this Act, applies only to an investigation, as that term is
7777 defined by that section, initiated by a municipality on or after the
7878 effective date of this Act.
7979 (b) Section 614.024(d), Government Code, as added by this
8080 Act, applies only to an agreement entered into on or after the
8181 effective date of this Act.
8282 SECTION 5. This Act takes effect September 1, 2023.
