11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. Subchapter D, Chapter 481, Health and Safety |
---|
13 | 13 | | Code, is amended by adding Section 481.142 to read as follows: |
---|
14 | 14 | | Sec. 481.142. OFFENSE: MANUFACTURE OR DELIVERY OF |
---|
15 | 15 | | CONTROLLED SUBSTANCE CAUSING DEATH OR SERIOUS BODILY INJURY. (a) A |
---|
16 | 16 | | person commits an offense if the person knowingly manufactures or |
---|
17 | 17 | | delivers a controlled substance in violation of this chapter and a |
---|
18 | 18 | | person dies or suffers serious bodily injury as a result of |
---|
19 | 19 | | injecting, ingesting, inhaling, or introducing into the person's |
---|
20 | 20 | | body any amount of the controlled substance manufactured or |
---|
21 | 21 | | delivered by the actor, regardless of whether the controlled |
---|
22 | 22 | | substance was used by itself or with another substance, including a |
---|
23 | 23 | | drug, adulterant, or dilutant. |
---|
24 | 24 | | (b) An offense under this section is: |
---|
25 | 25 | | (1) a felony of the second degree if the commission of |
---|
26 | 26 | | the offense resulted in serious bodily injury to a person; or |
---|
27 | 27 | | (2) a felony of the first degree if the commission of |
---|
28 | 28 | | the offense resulted in the death of a person. |
---|
29 | 29 | | (c) It is a defense to prosecution under this section that |
---|
30 | 30 | | the actor's conduct in manufacturing or delivering the controlled |
---|
31 | 31 | | substance was authorized under this chapter or other state or |
---|
32 | 32 | | federal law. |
---|
33 | 33 | | (d) If conduct constituting an offense under this section |
---|
34 | 34 | | also constitutes an offense under another section of this chapter |
---|
35 | 35 | | or the Penal Code, the actor may be prosecuted under either section |
---|
36 | 36 | | or both sections. |
---|
37 | 37 | | (e) Notwithstanding Article 42.08, Code of Criminal |
---|
38 | 38 | | Procedure, if a defendant is convicted of an offense under this |
---|
39 | 39 | | section, the court may not order the sentence for the offense to run |
---|
40 | 40 | | concurrently with any other sentence the court imposes on the |
---|
41 | 41 | | defendant. |
---|
42 | 42 | | SECTION 2. The changes in law made by this Act apply only to |
---|
43 | 43 | | an offense committed on or after the effective date of this Act. An |
---|
44 | 44 | | offense committed before the effective date of this Act is governed |
---|
45 | 45 | | by the law in effect on the date the offense was committed, and the |
---|
46 | 46 | | former law is continued in effect for that purpose. For purposes of |
---|
47 | 47 | | this section, an offense was committed before the effective date of |
---|
48 | 48 | | this Act if any element of the offense occurred before that date. |
---|
49 | 49 | | SECTION 3. This Act takes effect September 1, 2023. |
