44 AN ACT
55 relating to increasing the criminal penalty for certain family
66 violence assaults.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Sections 22.01(b) and (b-3), Penal Code, are
99 amended to read as follows:
1010 (b) An offense under Subsection (a)(1) is a Class A
1111 misdemeanor, except that the offense is a felony of the third degree
1212 if the offense is committed against:
1313 (1) a person the actor knows is a public servant while
1414 the public servant is lawfully discharging an official duty, or in
1515 retaliation or on account of an exercise of official power or
1616 performance of an official duty as a public servant;
1717 (2) a person whose relationship to or association with
1818 the defendant is described by Section 71.0021(b), 71.003, or
1919 71.005, Family Code, if:
2020 (A) it is shown on the trial of the offense that
2121 the defendant has been previously convicted of an offense that was
2222 committed:
2323 (i) [under this chapter, Chapter 19, or
2424 Section 20.03, 20.04, 21.11, or 25.11] against a person whose
2525 relationship to or association with the defendant is described by
2626 Section 71.0021(b), 71.003, or 71.005, Family Code; and
2727 (ii) under:
2828 (a) this chapter, Chapter 19, or
2929 Section 20.03, 20.04, 21.11, or 25.11;
3030 (b) Section 25.07, if the applicable
3131 violation was based on the commission of family violence as
3232 described by Subsection (a)(1) of that section; or
3333 (c) Section 25.072, if any of the
3434 applicable violations were based on the commission of family
3535 violence as described by Section 25.07(a)(1); or
3636 (B) the offense is committed by intentionally,
3737 knowingly, or recklessly impeding the normal breathing or
3838 circulation of the blood of the person by applying pressure to the
3939 person's throat or neck or by blocking the person's nose or mouth;
4040 (3) a person who contracts with government to perform
4141 a service in a facility as defined by Section 1.07(a)(14), Penal
4242 Code, or Section 51.02(13) or (14), Family Code, or an employee of
4343 that person:
4444 (A) while the person or employee is engaged in
4545 performing a service within the scope of the contract, if the actor
4646 knows the person or employee is authorized by government to provide
4747 the service; or
4848 (B) in retaliation for or on account of the
4949 person's or employee's performance of a service within the scope of
5050 the contract;
5151 (4) a person the actor knows is a security officer
5252 while the officer is performing a duty as a security officer;
5353 (5) a person the actor knows is emergency services
5454 personnel while the person is providing emergency services;
5555 (6) a person the actor knows is a process server while
5656 the person is performing a duty as a process server;
5757 (7) a pregnant individual to force the individual to
5858 have an abortion; or
5959 (8) a person the actor knows is pregnant at the time of
6060 the offense.
6161 (b-3) Notwithstanding Subsection (b)(2), an offense under
6262 Subsection (a)(1) is a felony of the second degree if:
6363 (1) the offense is committed against a person whose
6464 relationship to or association with the defendant is described by
6565 Section 71.0021(b), 71.003, or 71.005, Family Code;
6666 (2) it is shown on the trial of the offense that the
6767 defendant has been previously convicted of an offense that was
6868 committed:
6969 (A) [under this chapter, Chapter 19, or Section
7070 20.03, 20.04, or 21.11] against a person whose relationship to or
7171 association with the defendant is described by Section 71.0021(b),
7272 71.003, or 71.005, Family Code; and
7373 (B) under:
7474 (i) this chapter, Chapter 19, or Section
7575 20.03, 20.04, 21.11, or 25.11;
7676 (ii) Section 25.07, if the applicable
7777 violation was based on the commission of family violence as
7878 described by Subsection (a)(1) of that section; or
7979 (iii) Section 25.072, if any of the
8080 applicable violations were based on the commission of family
8181 violence as described by Section 25.07(a)(1); and
8282 (3) the offense is committed by intentionally,
8383 knowingly, or recklessly impeding the normal breathing or
8484 circulation of the blood of the person by applying pressure to the
8585 person's throat or neck or by blocking the person's nose or mouth.
8686 SECTION 2. The change in law made by this Act applies only
8787 to an offense committed on or after the effective date of this Act.
8888 An offense committed before the effective date of this Act is
8989 governed by the law in effect on the date the offense was committed,
9090 and the former law is continued in effect for that purpose. For
9191 purposes of this section, an offense was committed before the
9292 effective date of this Act if any element of the offense occurred
9393 before that date.
9494 SECTION 3. This Act takes effect September 1, 2023.
