| 7 | 7 | | self-insured or self-funded employee welfare benefit plans. |

| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 1275.002, Insurance Code, is amended to |
|---|
| 10 | 10 | | read as follows: |
|---|
| 11 | 11 | | Sec. 1275.002. APPLICABILITY OF CHAPTER. This chapter |
|---|
| 12 | 12 | | applies only to: |
|---|
| 13 | 13 | | (1) a health benefit plan offered by a nonprofit |
|---|
| 14 | 14 | | agricultural organization under Chapter 1682; and |
|---|
| 15 | 15 | | (2) a health benefit plan: |
|---|
| 16 | 16 | | (A) that is a self-insured or self-funded plan |
|---|
| 17 | 17 | | established by an employer for the benefit of the employer's |
|---|
| 18 | 18 | | employees in accordance with the Employee Retirement Income |
|---|
| 19 | 19 | | Security Act of 1974 (29 U.S.C. Section 1001 et seq.); and |
|---|
| 20 | 20 | | (B) for which the plan sponsor has made an |
|---|
| 21 | 21 | | election, submitted to the commissioner in the form and manner |
|---|
| 22 | 22 | | prescribed by the commissioner, to apply this chapter to the plan |
|---|
| 23 | 23 | | for the relevant plan year. |
|---|
| 24 | 24 | | SECTION 2. Not later than December 1, 2023, the |
|---|
| 25 | 25 | | commissioner of insurance shall adopt rules necessary to implement |
|---|
| 26 | 26 | | the change in law made by this Act. |
|---|
| 27 | 27 | | SECTION 3. This Act takes effect September 1, 2023. |
