66 AN ACT
77 relating to the duties of social media companies regarding
88 prostitution and trafficking of persons; creating a criminal
99 offense.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Title 99, Business & Commerce Code, is amended by
1212 adding Chapter 2005 to read as follows:
1313 CHAPTER 2005. DUTIES OF SOCIAL MEDIA COMPANY REGARDING
1414 PROSTITUTION AND TRAFFICKING OF PERSONS
1515 Sec. 2005.001. DEFINITIONS. In this chapter:
1616 (1) "Social media company" means a business entity
1717 that provides or operates a social media website.
1818 (2) "Social media website" means an interactive
1919 Internet website or application that enables multiple users to
2020 communicate with other users by posting, creating, sharing, or
2121 viewing content, including instant messages, blogs, information,
2222 comments, videos, and images. The term includes Facebook,
2323 Instagram, and Twitter.
2424 Sec. 2005.002. PROSTITUTION AND TRAFFICKING OF PERSONS ON
2525 SOCIAL MEDIA WEBSITES. (a) A social media company may not allow a
2626 person to use the company's social media website for engaging in
2727 conduct that constitutes an offense under Chapter 20A, Penal Code,
2828 or Subchapter A, Chapter 43, Penal Code.
2929 (b) A social media company that discovers a person is using
3030 the company's social media website to engage in conduct described
3131 by Subsection (a) shall:
3232 (1) preserve the offending content;
3333 (2) notify the appropriate law enforcement authority;
3434 (3) remove the offending content from being publicly
3535 accessible; and
3636 (4) either:
3737 (A) suspend the account to which the content was
3838 posted; or
3939 (B) issue a warning to the account holder that
4040 posted the content.
4141 (c) A social media company commits an offense if the company
4242 violates this section. An offense under this subsection is a Class
4343 A misdemeanor except that the offense is a state jail felony if the
4444 conduct is committed intentionally or knowingly.
4545 SECTION 2. This Act takes effect September 1, 2023.
