77 AN ACT
88 relating to a report by the Texas Higher Education Coordinating
99 Board regarding enrollment and success in higher education for
1010 students with disabilities.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter C, Chapter 61, Education Code, is
1313 amended by adding Section 61.06642 to read as follows:
1414 Sec. 61.06642. REPORT REGARDING ENROLLMENT AND SUCCESS IN
1515 HIGHER EDUCATION FOR STUDENTS WITH DISABILITIES. (a) Not later
1616 than September 1, 2024, the board shall prepare and submit to the
1717 legislature a report on enrollment and success in higher education
1818 for students with a disability.
1919 (b) The report must identify, to the extent practicable:
2020 (1) the number and percentage of students with a
2121 disability who enroll in an institution of higher education or
2222 private or independent institution of higher education;
2323 (2) barriers to enrollment in higher education for
2424 students with a disability;
2525 (3) policies of institutions of higher education or
2626 private or independent institutions of higher education that
2727 promote enrollment and success in higher education for students
2828 with a disability;
2929 (4) whether services and accommodations for students
3030 with a disability are accessible at institutions of higher
3131 education or private or independent institutions of higher
3232 education;
3333 (5) whether institutions of higher education or
3434 private or independent institutions of higher education provide to
3535 students with a disability sufficient and accurate information
3636 regarding the educational rights and protections for persons with a
3737 disability under state and federal law; and
3838 (6) any recommendations for legislative or other
3939 action.
4040 (c) An institution of higher education shall provide to the
4141 board on request, and the board may request from a private or
4242 independent institution of higher education, any information
4343 necessary for the board to prepare the report.
4444 (d) This section expires September 1, 2025.
4545 SECTION 2. This Act takes effect immediately if it receives
4646 a vote of two-thirds of all the members elected to each house, as
4747 provided by Section 39, Article III, Texas Constitution. If this
4848 Act does not receive the vote necessary for immediate effect, this
4949 Act takes effect September 1, 2023.
