| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Subchapter C, Chapter 61, Education Code, is |
|---|
| 13 | 13 | | amended by adding Section 61.06642 to read as follows: |
|---|
| 14 | 14 | | Sec. 61.06642. REPORT REGARDING ENROLLMENT AND SUCCESS IN |
|---|
| 15 | 15 | | HIGHER EDUCATION FOR STUDENTS WITH DISABILITIES. (a) Not later |
|---|
| 16 | 16 | | than September 1, 2024, the board shall prepare and submit to the |
|---|
| 17 | 17 | | legislature a report on enrollment and success in higher education |
|---|
| 18 | 18 | | for students with a disability. |
|---|
| 19 | 19 | | (b) The report must identify, to the extent practicable: |
|---|
| 20 | 20 | | (1) the number and percentage of students with a |
|---|
| 21 | 21 | | disability who enroll in an institution of higher education or |
|---|
| 22 | 22 | | private or independent institution of higher education; |
|---|
| 23 | 23 | | (2) barriers to enrollment in higher education for |
|---|
| 24 | 24 | | students with a disability; |
|---|
| 25 | 25 | | (3) policies of institutions of higher education or |
|---|
| 26 | 26 | | private or independent institutions of higher education that |
|---|
| 27 | 27 | | promote enrollment and success in higher education for students |
|---|
| 28 | 28 | | with a disability; |
|---|
| 29 | 29 | | (4) whether services and accommodations for students |
|---|
| 30 | 30 | | with a disability are accessible at institutions of higher |
|---|
| 31 | 31 | | education or private or independent institutions of higher |
|---|
| 32 | 32 | | education; |
|---|
| 33 | 33 | | (5) whether institutions of higher education or |
|---|
| 34 | 34 | | private or independent institutions of higher education provide to |
|---|
| 35 | 35 | | students with a disability sufficient and accurate information |
|---|
| 36 | 36 | | regarding the educational rights and protections for persons with a |
|---|
| 37 | 37 | | disability under state and federal law; and |
|---|
| 38 | 38 | | (6) any recommendations for legislative or other |
|---|
| 39 | 39 | | action. |
|---|
| 40 | 40 | | (c) An institution of higher education shall provide to the |
|---|
| 41 | 41 | | board on request, and the board may request from a private or |
|---|
| 42 | 42 | | independent institution of higher education, any information |
|---|
| 43 | 43 | | necessary for the board to prepare the report. |
|---|
| 44 | 44 | | (d) This section expires September 1, 2025. |
|---|
| 45 | 45 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 46 | 46 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 47 | 47 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 48 | 48 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 49 | 49 | | Act takes effect September 1, 2023. |
|---|
