| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. The heading to Section 392.0162, Local |
|---|
| 12 | 12 | | Government Code, is amended to read as follows: |
|---|
| 13 | 13 | | Sec. 392.0162. AREA OF OPERATION OF AND PUBLIC FACILITY |
|---|
| 14 | 14 | | CORPORATIONS CREATED BY CERTAIN MUNICIPAL HOUSING AUTHORITIES. |

| 15 | 15 | | SECTION 2. Section 392.0162, Local Government Code, is |
|---|
| 16 | 16 | | amended by adding Subsection (d) to read as follows: |

| 17 | 17 | | (d) For all purposes, including the application of Chapter |
|---|
| 18 | 18 | | 101, Civil Practice and Remedies Code, a public facility |
|---|
| 19 | 19 | | corporation is a unit of government and the functions of the |
|---|
| 20 | 20 | | corporation are essential governmental functions and not |
|---|
| 21 | 21 | | proprietary functions if the corporation: |
|---|
| 22 | 22 | | (1) is created by a municipal housing authority that |
|---|
| 23 | 23 | | is approved to operate in the area described by Subsection (b)(2); |
|---|
| 24 | 24 | | and |
|---|
| 25 | 25 | | (2) owns or has an interest in a housing project that |
|---|
| 26 | 26 | | qualifies for an exemption under Section 392.005. |
|---|
| 27 | 27 | | SECTION 3. The change in law made by this Act applies only |
|---|
| 28 | 28 | | to a cause of action that accrues on or after the effective date of |
|---|
| 29 | 29 | | this Act. |
|---|
| 30 | 30 | | SECTION 4. This Act takes effect September 1, 2023. |
