| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter D, Chapter 392, Local Government |
|---|
| 11 | 11 | | Code, is amended by adding Section 392.0566 to read as follows: |

| 12 | 12 | | Sec. 392.0566. PROCUREMENT PROCEDURES FOR CERTAIN |
|---|
| 13 | 13 | | MUNICIPAL HOUSING AUTHORITIES. Notwithstanding any other law, a |
|---|
| 14 | 14 | | municipal housing authority described by Section 392.0162 is |
|---|
| 15 | 15 | | required to comply with competitive procurement procedures |
|---|
| 16 | 16 | | applicable to municipal housing authorities only when making a |
|---|
| 17 | 17 | | purchase requiring the expenditure of an amount that is more than |
|---|
| 18 | 18 | | the simplified acquisition threshold as defined by the Federal |
|---|
| 19 | 19 | | Acquisition Regulation (48 C.F.R. Section 2.101) or a successor |
|---|
| 20 | 20 | | regulation. |
|---|
| 21 | 21 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 22 | 22 | | to a purchase made on or after the effective date of this Act. A |
|---|
| 23 | 23 | | purchase made before the effective date of this Act is governed by |
|---|
| 24 | 24 | | the law as it existed immediately before the effective date of this |
|---|
| 25 | 25 | | Act, and that law is continued in effect for that purpose. |
|---|
| 26 | 26 | | SECTION 3. This Act takes effect September 1, 2023. |
