77 relating to purchase of service credit in the Teacher Retirement
88 System of Texas by certain members with federal border security
99 service work experience.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. The heading to Subchapter D, Chapter 823,
1212 Government Code, is amended to read as follows:
1313 SUBCHAPTER D. ESTABLISHMENT OF MILITARY AND FEDERAL BORDER
1414 SECURITY SERVICE
1515 SECTION 2. Subchapter D, Chapter 823, Government Code, is
1616 amended by adding Section 823.305 to read as follows:
1717 Sec. 823.305. FEDERAL BORDER SECURITY SERVICE CREDIT. (a)
1818 An eligible member may establish membership service credit for
1919 federal border security service performed that is creditable in the
2020 retirement system as provided by this section.
2121 (b) Federal border security service creditable in the
2222 retirement system is work performed as an employee of:
2323 (1) the United States Department of Homeland Security,
2424 including U.S. Customs and Border Protection; or
2525 (2) any other federal agency with primary
2626 responsibility for securing the United States-Mexico border by
2727 interdicting:
2828 (A) persons attempting to illegally enter or exit
2929 the United States; or
3030 (B) goods being illegally imported into or
3131 exported from the United States.
3232 (c) A member may not establish more than five years of
3333 service credit in the retirement system under this section for
3434 federal border security service.
3535 (d) A member eligible to establish federal border security
3636 service credit is one who has at least five years of service credit
3737 in the retirement system for actual service in public schools.
3838 (e) A member may establish credit under this section by
3939 depositing with the retirement system for each year of federal
4040 border security service claimed a contribution in an amount equal
4141 to the member's contributions to the retirement system during the
4242 first full year of membership service.
4343 (f) After a member makes the deposits required by this
4444 section, the retirement system shall grant the member one year of
4545 federal border security service credit for each year of federal
4646 border security service approved.
4747 (g) The board of trustees may adopt rules necessary to
4848 implement this section.
4949 SECTION 3. Section 825.307(a), Government Code, is amended
5050 to read as follows:
5151 (a) The retirement system shall deposit in a member's
5252 individual account in the member savings account:
5353 (1) the amount of contributions to the retirement
5454 system that is deducted from the member's compensation;
5555 (2) the portion of a deposit made on or after
5656 resumption of membership that represents the amount of retirement
5757 benefits received;
5858 (3) the portion of a deposit to reinstate service
5959 credit previously canceled that represents the amount withdrawn or
6060 refunded;
6161 (4) the portion of a deposit to establish military
6262 service credit required by Section 823.302(c);
6363 (5) the portion of a deposit to establish USERRA
6464 credit required by Section 823.304(c);
6565 (6) the portion of a deposit to establish federal
6666 border security service credit required by Section 823.305(e);
6767 (7) the portion of a deposit to establish:
6868 (A) equivalent membership service credit
6969 required by Section 823.401(d), 823.402(e), 823.403(d),
7070 823.404(c), or 823.406(b) or former Section 823.405; or
7171 (B) unreported service credit or compensation
7272 required by Section 825.403(h); and
7373 (8) [(7)] interest earned on money in the account as
7474 provided by Subsections (b) and (c) and Section 825.313(c).
7575 SECTION 4. Section 823.305, Government Code, as added by
7676 this Act, applies only to a member of the Teacher Retirement System
7777 of Texas who retires on or after the effective date of this Act.
7878 SECTION 5. This Act takes effect September 1, 2023.
