10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 11 | | SECTION 1. The heading to Subchapter D, Chapter 823, |
---|
12 | 12 | | Government Code, is amended to read as follows: |
---|
13 | 13 | | SUBCHAPTER D. ESTABLISHMENT OF MILITARY AND FEDERAL BORDER |
---|
14 | 14 | | SECURITY SERVICE |
---|
15 | 15 | | SECTION 2. Subchapter D, Chapter 823, Government Code, is |
---|
16 | 16 | | amended by adding Section 823.305 to read as follows: |
---|
17 | 17 | | Sec. 823.305. FEDERAL BORDER SECURITY SERVICE CREDIT. (a) |
---|
18 | 18 | | An eligible member may establish membership service credit for |
---|
19 | 19 | | federal border security service performed that is creditable in the |
---|
20 | 20 | | retirement system as provided by this section. |
---|
21 | 21 | | (b) Federal border security service creditable in the |
---|
22 | 22 | | retirement system is work performed as an employee of: |
---|
23 | 23 | | (1) the United States Department of Homeland Security, |
---|
24 | 24 | | including U.S. Customs and Border Protection; or |
---|
25 | 25 | | (2) any other federal agency with primary |
---|
26 | 26 | | responsibility for securing the United States-Mexico border by |
---|
27 | 27 | | interdicting: |
---|
28 | 28 | | (A) persons attempting to illegally enter or exit |
---|
29 | 29 | | the United States; or |
---|
30 | 30 | | (B) goods being illegally imported into or |
---|
31 | 31 | | exported from the United States. |
---|
32 | 32 | | (c) A member may not establish more than five years of |
---|
33 | 33 | | service credit in the retirement system under this section for |
---|
34 | 34 | | federal border security service. |
---|
35 | 35 | | (d) A member eligible to establish federal border security |
---|
36 | 36 | | service credit is one who has at least five years of service credit |
---|
37 | 37 | | in the retirement system for actual service in public schools. |
---|
38 | 38 | | (e) A member may establish credit under this section by |
---|
39 | 39 | | depositing with the retirement system for each year of federal |
---|
40 | 40 | | border security service claimed a contribution in an amount equal |
---|
41 | 41 | | to the member's contributions to the retirement system during the |
---|
42 | 42 | | first full year of membership service. |
---|
43 | 43 | | (f) After a member makes the deposits required by this |
---|
44 | 44 | | section, the retirement system shall grant the member one year of |
---|
45 | 45 | | federal border security service credit for each year of federal |
---|
46 | 46 | | border security service approved. |
---|
47 | 47 | | (g) The board of trustees may adopt rules necessary to |
---|
48 | 48 | | implement this section. |
---|
49 | 49 | | SECTION 3. Section 825.307(a), Government Code, is amended |
---|
50 | 50 | | to read as follows: |
---|
51 | 51 | | (a) The retirement system shall deposit in a member's |
---|
52 | 52 | | individual account in the member savings account: |
---|
53 | 53 | | (1) the amount of contributions to the retirement |
---|
54 | 54 | | system that is deducted from the member's compensation; |
---|
55 | 55 | | (2) the portion of a deposit made on or after |
---|
56 | 56 | | resumption of membership that represents the amount of retirement |
---|
57 | 57 | | benefits received; |
---|
58 | 58 | | (3) the portion of a deposit to reinstate service |
---|
59 | 59 | | credit previously canceled that represents the amount withdrawn or |
---|
60 | 60 | | refunded; |
---|
61 | 61 | | (4) the portion of a deposit to establish military |
---|
62 | 62 | | service credit required by Section 823.302(c); |
---|
63 | 63 | | (5) the portion of a deposit to establish USERRA |
---|
64 | 64 | | credit required by Section 823.304(c); |
---|
65 | 65 | | (6) the portion of a deposit to establish federal |
---|
66 | 66 | | border security service credit required by Section 823.305(e); |
---|
67 | 67 | | (7) the portion of a deposit to establish: |
---|
68 | 68 | | (A) equivalent membership service credit |
---|
69 | 69 | | required by Section 823.401(d), 823.402(e), 823.403(d), |
---|
70 | 70 | | 823.404(c), or 823.406(b) or former Section 823.405; or |
---|
71 | 71 | | (B) unreported service credit or compensation |
---|
72 | 72 | | required by Section 825.403(h); and |
---|
73 | 73 | | (8) [(7)] interest earned on money in the account as |
---|
74 | 74 | | provided by Subsections (b) and (c) and Section 825.313(c). |
---|
75 | 75 | | SECTION 4. Section 823.305, Government Code, as added by |
---|
76 | 76 | | this Act, applies only to a member of the Teacher Retirement System |
---|
77 | 77 | | of Texas who retires on or after the effective date of this Act. |
---|
78 | 78 | | SECTION 5. This Act takes effect September 1, 2023. |
