55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to a study on maternal mortality and morbidity among Black
88 women in this state.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. (a) In this section:
1111 (1) "Department" means the Department of State Health
1212 Services.
1313 (2) "Review committee" means the Texas Maternal
1414 Mortality and Morbidity Review Committee established under Chapter
1515 34, Health and Safety Code.
1616 (b) The review committee and the department shall jointly
1717 conduct a study to evaluate maternal mortality and morbidity among
1818 Black women in this state. In conducting the study, the review
1919 committee and department shall:
2020 (1) compare maternal mortality and morbidity rates
2121 among Black women in this state in relation to maternal mortality
2222 and morbidity rates among each other race and ethnicity;
2323 (2) compare maternal mortality and morbidity rates
2424 among Black women in this state in relation to socioeconomic status
2525 and education level;
2626 (3) assess the impact of social determinants of
2727 health, including an evaluation of data on pregnancy-related
2828 deaths, pregnancy-related complications that almost resulted in
2929 death, and morbidities, to identify any correlation in that data to
3030 women who are uninsured, women who receive health care coverage
3131 under Medicaid, and women who receive health care coverage through
3232 a private insurer;
3333 (4) evaluate the impact of the following health
3434 conditions on maternal mortality and morbidity:
3535 (A) cardiac health conditions;
3636 (B) preeclampsia, eclampsia, and other
3737 hypertensive disorders;
3838 (C) hemorrhage;
3939 (D) obesity; and
4040 (E) stress-related health conditions; and
4141 (5) assess the extent to which implicit biases held by
4242 health care providers against Black individuals affect maternal
4343 mortality and morbidity among Black women.
4444 (c) Based on the results of the study conducted under this
4545 section, the review committee and department shall develop
4646 recommendations to address disparities in maternal mortality and
4747 morbidity among Black women, including recommendations on:
4848 (1) strategies to reduce the incidence of
4949 pregnancy-related deaths and severe maternal morbidity;
5050 (2) patient outreach and education;
5151 (3) health care provider training, including a
5252 recommendation on the potential benefit of training on cultural
5353 competency and implicit biases against Black individuals;
5454 (4) best practices identified as successful in
5555 reducing maternal mortality and morbidity; and
5656 (5) the implementation in this state of programs
5757 operating in other states that have reduced maternal mortality and
5858 morbidity rates.
5959 (d) Not later than September 1, 2024, the review committee
6060 and department shall prepare and submit to the governor, lieutenant
6161 governor, speaker of the house of representatives, and appropriate
6262 committees of the legislature a written report that summarizes the
6363 results of the study and includes the recommendations developed
6464 under this section. The report may be consolidated with the
6565 biennial report required under Section 34.015, Health and Safety
6666 Code.
6767 SECTION 2. This Act expires December 31, 2024.
6868 SECTION 3. This Act takes effect immediately if it receives
6969 a vote of two-thirds of all the members elected to each house, as
7070 provided by Section 39, Article III, Texas Constitution. If this
7171 Act does not receive the vote necessary for immediate effect, this
7272 Act takes effect September 1, 2023.
