66 AN ACT
77 relating to state funding for school districts to which an
88 academically unacceptable school district is annexed.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 13.054, Education Code, is amended by
1111 amending Subsection (f) and adding Subsections (i-1), (i-2), and
1212 (i-3) to read as follows:
1313 (f) For five years beginning with the school year in which
1414 the annexation occurs, a school district shall receive additional
1515 funding under this subsection or Subsection (h). The amount of
1616 funding shall be determined by multiplying the lesser of the
1717 enlarged district's local fund assignment computed under Section
1818 48.256 or the enlarged district's total cost of tier one by a
1919 fraction, the numerator of which is the number of students residing
2020 in the territory annexed to the receiving district preceding the
2121 date of the annexation and the denominator of which is the number of
2222 students residing in the district as enlarged on the date of the
2323 annexation, and multiplying the resulting product by the quotient
2424 of the enlarged district's maximum compressed tax rate, as
2525 determined under Section 48.2551, for the current school year
2626 divided by the receiving district's maximum compressed tax rate, as
2727 determined under Section 48.2551, for the year in which the
2828 annexation occurred. The commissioner shall provide the funding
2929 under this subsection from funds appropriated for purposes of the
3030 Foundation School Program. A determination by the commissioner
3131 under this subsection is final and may not be appealed.
3232 (i-1) Notwithstanding any other law, a school district is
3333 entitled to funding under this section for an annexation that
3434 occurs on or after June 1, 2013.
3535 (i-2) For each school district entitled to funding under
3636 this section as provided by Subsection (i-1) that, as of September
3737 1, 2023, has not received the full amount of funding to which the
3838 district would have been entitled under this section if that
3939 subsection had been in effect since June 1, 2013, the commissioner
4040 shall:
4141 (1) determine the difference between:
4242 (A) the amount of funding to which the district
4343 would have been entitled under this section if Subsection (i-1) had
4444 been in effect since June 1, 2013; and
4545 (B) the amount of funding the district has
4646 received under this section; and
4747 (2) provide the amount determined under Subdivision
4848 (1) to the district in the form of:
4949 (A) a lump sum; or
5050 (B) equal annual installments over a period not
5151 to exceed three years.
5252 (i-3) This subsection and Subsection (i-2) expire September
5353 1, 2027.
5454 SECTION 2. This Act takes effect September 1, 2023.
