55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to a residential landlord's duty regarding the provision
88 of certain information.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 92.020, Property Code, is amended by
1111 adding Subsection (e) to read as follows:
1212 (e) If a telephone number provided by a landlord to a tenant
1313 under Subsection (a) or (d) becomes incorrect, the landlord shall:
1414 (1) if Subsection (a) applies to the landlord, post a
1515 notice of the change, including the correct telephone number, in
1616 the manner required by Subsection (b) not later than 24 hours after
1717 the time the telephone number becomes incorrect; and
1818 (2) regardless of whether Subsection (a) applies to
1919 the landlord, give notice of the change, including the correct
2020 telephone number, to the tenant in the tenant's primary language:
2121 (A) by any method within 24 hours after the time
2222 the telephone number becomes incorrect; and
2323 (B) in writing not later than the third day after
2424 the day the telephone number becomes incorrect:
2525 (i) in a paper format by mail or delivered
2626 in person;
2727 (ii) in an electronic format if requested
2828 by the tenant; or
2929 (iii) by e-mail if the landlord and tenant
3030 have communicated by e-mail.
3131 SECTION 2. The heading to Section 92.201, Property Code, is
3232 amended to read as follows:
3333 Sec. 92.201. DISCLOSURE OF OWNERSHIP AND MANAGEMENT;
3434 CONTACT INFORMATION.
3535 SECTION 3. Sections 92.201(a) and (e), Property Code, are
3636 amended to read as follows:
3737 (a) A landlord shall disclose to a tenant, or to any
3838 government official or employee acting in an official capacity,
3939 according to this subchapter:
4040 (1) the name and either a street or post office box
4141 address of the holder of record title, according to the deed records
4242 in the county clerk's office, of the dwelling rented by the tenant
4343 or inquired about by the government official or employee acting in
4444 an official capacity; [and]
4545 (2) if an entity located off-site from the dwelling is
4646 primarily responsible for managing the dwelling, the name and
4747 street address of the management company; and
4848 (3) a telephone number, e-mail address, or other
4949 reasonable method for contacting the landlord or management company
5050 during normal business hours.
5151 (e) A correction to the information disclosed to a
5252 government official or employee under this section may be made by
5353 any of the methods authorized for providing the information.
5454 SECTION 4. Section 92.203, Property Code, is amended to
5555 read as follows:
5656 Sec. 92.203. LANDLORD'S FAILURE TO CORRECT INFORMATION
5757 PROVIDED TO TENANT. (a) A landlord who has provided information
5858 under [Subdivision (2) or (3) of Subsection (b) of] Section 92.201
5959 is liable to a tenant according to this subchapter if:
6060 (1) the information becomes incorrect because a name,
6161 [or] address, telephone number, e-mail address, or other method of
6262 contact changes; and
6363 (2) the landlord fails to correct the information as
6464 required by Subsection (b) [on or before the seventh day after the
6565 date the tenant gives the landlord written notice that the tenant
6666 may exercise the remedies under this subchapter if the corrected
6767 information is not provided within seven days].
6868 (b) If information provided by a landlord to a tenant
6969 becomes incorrect as described by Subsection (a)(1), a landlord
7070 shall give notice of the change, including the correct information,
7171 in the tenant's primary language:
7272 (1) by any method within 48 hours after the time the
7373 information becomes incorrect; and
7474 (2) in writing not later than the seventh business day
7575 after the day the information becomes incorrect:
7676 (A) in a paper format by mail or delivered in
7777 person;
7878 (B) in an electronic format if requested by the
7979 tenant; or
8080 (C) by e-mail if the landlord and tenant have
8181 communicated by e-mail.
8282 SECTION 5. Section 92.204, Property Code, is amended to
8383 read as follows:
8484 Sec. 92.204. BAD FAITH VIOLATION. A landlord acts in bad
8585 faith and is liable according to this subchapter if the landlord
8686 gives an incorrect name, [or] address, telephone number, e-mail
8787 address, or other method of contact under [Subsection (a) of]
8888 Section 92.201(a) [92.201] by wilfully:
8989 (1) disclosing incorrect information under Section
9090 92.201(b)(1) or (2) or Section 92.201(d); or
9191 (2) failing to correct information given under Section
9292 92.201(b)(1) or (2) or Section 92.201(d) that the landlord knows is
9393 incorrect.
9494 SECTION 6. (a) The changes in law made by this Act to
9595 Sections 92.201(a) and 92.204, Property Code, apply only to
9696 disclosure of contact information made on or after the effective
9797 date of this Act. Disclosure of contact information made before the
9898 effective date of this Act is governed by the law in effect on the
9999 date the disclosure was made, and that law is continued in effect
100100 for that purpose.
101101 (b) The change in law made by this Act to Section 92.203,
102102 Property Code, applies only to liability for failure to correct
103103 contact information given on or after the effective date of this
104104 Act. Liability for failure to correct contact information given
105105 before the effective date of this Act is governed by the law in
106106 effect when the contact information was given, and that law is
107107 continued in effect for that purpose.
108108 SECTION 7. This Act takes effect September 1, 2023.
