| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Chapter 197, Acts of the 59th Legislature, |
|---|
| 9 | 9 | | Regular Session, 1965, is amended by adding Section 22A to read as |
|---|
| 10 | 10 | | follows: |
|---|
| 11 | 11 | | Sec. 22A. FEES. (a) The Board may impose: |
|---|
| 12 | 12 | | (1) a combined production and export fee on water |
|---|
| 13 | 13 | | exported from the District in an amount not to exceed 20 cents for |
|---|
| 14 | 14 | | each thousand gallons of water exported from the District; and |
|---|
| 15 | 15 | | (2) other fees as authorized by Chapter 36, Water |
|---|
| 16 | 16 | | Code. |
|---|
| 17 | 17 | | (b) A fee collected under Subsection (a)(1) of this section |
|---|
| 18 | 18 | | may only be used: |
|---|
| 19 | 19 | | (1) to maintain the operability of wells significantly |
|---|
| 20 | 20 | | affected by groundwater export projects; and |
|---|
| 21 | 21 | | (2) as authorized by Section 36.122(l), Water Code. |
|---|
| 22 | 22 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 23 | 23 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 24 | 24 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 25 | 25 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 26 | 26 | | Act takes effect September 1, 2023. |
