66 AN ACT
77 relating to an unauthorized vote by a delegate or alternate
88 delegate to a federal Article V convention; creating a criminal
99 offense.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter C, Chapter 393, Government Code, is
1212 amended by adding Section 393.1035 to read as follows:
1313 Sec. 393.1035. CRIMINAL PENALTY. (a) A delegate or
1414 alternate delegate commits an offense if the delegate or alternate
1515 delegate knowingly casts an unauthorized vote.
1616 (b) An offense under this section is a state jail felony.
1717 (c) A judge granting community supervision to a defendant
1818 convicted of an offense under this section shall require as a
1919 condition of community supervision that the defendant submit to not
2020 less than 10 days of confinement in county jail. If a sentence of
2121 confinement is imposed on the revocation of community supervision,
2222 the term of confinement served under this subsection may not be
2323 credited toward completion of the sentence imposed.
2424 SECTION 2. This Act takes effect September 1, 2023.
