77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Article 42A.558, Code of Criminal Procedure, is
99 amended by adding Subsections (b-1) and (b-2) to read as follows:
1010 (b-1) On request of the judge, the Texas Department of
1111 Criminal Justice shall, not later than the 60th day after the date
1212 the defendant is received into the custody of a state jail felony
1313 facility, notify the judge of the date on which the defendant will
1414 have served 75 days in the facility. The notice must be provided by
1515 e-mail or other electronic communication.
1616 (b-2) For purposes of Subsection (b-1), the judge may submit
1717 a single request to the Texas Department of Criminal Justice with
1818 respect to all applicable defendants sentenced in the judge's
1919 court.
2020 SECTION 2. The change in law made by this Act to Article
2121 42A.558, Code of Criminal Procedure, applies only to a defendant
2222 who receives a sentence of confinement in a state jail felony
2323 facility on or after the effective date of this Act. A defendant
2424 who receives a sentence of confinement in a state jail felony
2525 facility before the effective date of this Act is governed by the
2626 law in effect at the time of sentencing, and the former law is
2727 continued in effect for that purpose.
2828 SECTION 3. This Act takes effect September 1, 2024.
