| 5 | 5 | | relating to notice provided to a court regarding a defendant |

| 6 | 6 | | confined in a state jail felony facility. |

| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Article 42A.558, Code of Criminal Procedure, is |
|---|
| 9 | 9 | | amended by adding Subsections (b-1) and (b-2) to read as follows: |
|---|
| 10 | 10 | | (b-1) On request of the judge, the Texas Department of |
|---|
| 11 | 11 | | Criminal Justice shall, not later than the 60th day after the date |
|---|
| 12 | 12 | | the defendant is received into the custody of a state jail felony |
|---|
| 13 | 13 | | facility, notify the judge of the date on which the defendant will |
|---|
| 14 | 14 | | have served 75 days in the facility. The notice must be provided by |
|---|
| 15 | 15 | | e-mail or other electronic communication. |
|---|
| 16 | 16 | | (b-2) For purposes of Subsection (b-1), the judge may submit |
|---|
| 17 | 17 | | a single request to the Texas Department of Criminal Justice with |
|---|
| 18 | 18 | | respect to all applicable defendants sentenced in the judge's |
|---|
| 19 | 19 | | court. |
|---|
| 20 | 20 | | SECTION 2. The change in law made by this Act to Article |
|---|
| 21 | 21 | | 42A.558, Code of Criminal Procedure, applies only to a defendant |
|---|
| 22 | 22 | | who receives a sentence of confinement in a state jail felony |
|---|
| 23 | 23 | | facility on or after the effective date of this Act. A defendant |
|---|
| 24 | 24 | | who receives a sentence of confinement in a state jail felony |
|---|
| 25 | 25 | | facility before the effective date of this Act is governed by the |
|---|
| 26 | 26 | | law in effect at the time of sentencing, and the former law is |
|---|
| 27 | 27 | | continued in effect for that purpose. |
|---|
| 28 | 28 | | SECTION 3. This Act takes effect September 1, 2024. |
