| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 81.051, Natural Resources Code, is |
|---|
| 11 | 11 | | amended by adding Subsection (c) to read as follows: |
|---|
| 12 | 12 | | (c) The commission's jurisdiction described by this section |
|---|
| 13 | 13 | | includes the responsibility and authority to secure pipelines and |
|---|
| 14 | 14 | | other oil and gas infrastructure in this state against severe |
|---|
| 15 | 15 | | weather events, cybersecurity threats, acts of terrorism, and other |
|---|
| 16 | 16 | | potential disruptions to the production of oil and gas in this |
|---|
| 17 | 17 | | state. |

| 18 | 18 | | SECTION 2. Subchapter C, Chapter 81, Natural Resources |
|---|
| 19 | 19 | | Code, is amended by adding Section 81.0535 to read as follows: |
|---|
| 20 | 20 | | Sec. 81.0535. OIL AND GAS INFRASTRUCTURE SECURITY DIVISION. |
|---|
| 21 | 21 | | (a) In this section, "division" means the oil and gas |
|---|
| 22 | 22 | | infrastructure security division. |
|---|
| 23 | 23 | | (b) The commission shall establish within the agency the oil |
|---|
| 24 | 24 | | and gas infrastructure security division with the primary |
|---|
| 25 | 25 | | responsibility and authority to secure pipelines and other oil and |
|---|
| 26 | 26 | | gas infrastructure in this state against severe weather events, |
|---|
| 27 | 27 | | cybersecurity threats, acts of terrorism, and other potential |
|---|
| 28 | 28 | | disruptions to the production of oil and gas in this state. |
|---|
| 29 | 29 | | (c) The division shall: |
|---|
| 30 | 30 | | (1) periodically conduct risk assessments of the oil |
|---|
| 31 | 31 | | and gas infrastructure in this state; and |
|---|
| 32 | 32 | | (2) establish guidelines and adopt rules to: |
|---|
| 33 | 33 | | (A) address vulnerabilities identified by risk |
|---|
| 34 | 34 | | assessments conducted under Subdivision (1); and |
|---|
| 35 | 35 | | (B) otherwise satisfy the responsibilities |
|---|
| 36 | 36 | | described by Subsection (b). |
|---|
| 37 | 37 | | (d) The division shall solicit input from interested |
|---|
| 38 | 38 | | persons when establishing guidelines under Subsection (c)(2). |
|---|
| 39 | 39 | | (e) The chairman shall select commission employees to staff |
|---|
| 40 | 40 | | the division. |
|---|
| 41 | 41 | | SECTION 3. This Act takes effect September 1, 2023. |
