55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the payment of certain employer contributions for
88 retirees of the Teacher Retirement System of Texas who resume
99 service.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 825.4092(f), Government Code, as added
1212 by Chapter 546 (S.B. 202), Acts of the 87th Legislature, Regular
1313 Session, 2021, is amended to read as follows:
1414 (f) A reporting employer may recover the cost [is ultimately
1515 responsible for payment] of the amounts required to be contributed
1616 under Subsections (b) and (c) from [. The employer may not directly
1717 or indirectly pass that cost on to] the retiree through payroll
1818 deduction, but only to the extent the deduction would not result in
1919 the retiree's compensation equaling an amount that is less than the
2020 minimum salary required by Section 21.402, Education Code, if
2121 applicable [, by imposition of a fee, or by any other means designed
2222 to recover the cost].
2323 SECTION 2. The changes in law made by this Act apply to a
2424 retiree of the Teacher Retirement System of Texas regardless of
2525 whether the person retired from employment before, on, or after the
2626 effective date of this Act.
2727 SECTION 3. The changes in law made by this Act apply
2828 beginning with the 2023-2024 school year.
2929 SECTION 4. This Act takes effect immediately if it receives
3030 a vote of two-thirds of all the members elected to each house, as
3131 provided by Section 39, Article III, Texas Constitution. If this
3232 Act does not receive the vote necessary for immediate effect, this
3333 Act takes effect September 1, 2023.
