| 8 | 8 | | retirees of the Teacher Retirement System of Texas who resume |

| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 825.4092(f), Government Code, as added |
|---|
| 12 | 12 | | by Chapter 546 (S.B. 202), Acts of the 87th Legislature, Regular |
|---|
| 13 | 13 | | Session, 2021, is amended to read as follows: |
|---|
| 14 | 14 | | (f) A reporting employer may recover the cost [is ultimately |
|---|
| 15 | 15 | | responsible for payment] of the amounts required to be contributed |
|---|
| 16 | 16 | | under Subsections (b) and (c) from [. The employer may not directly |
|---|
| 17 | 17 | | or indirectly pass that cost on to] the retiree through payroll |
|---|
| 18 | 18 | | deduction, but only to the extent the deduction would not result in |
|---|
| 19 | 19 | | the retiree's compensation equaling an amount that is less than the |
|---|
| 20 | 20 | | minimum salary required by Section 21.402, Education Code, if |
|---|
| 21 | 21 | | applicable [, by imposition of a fee, or by any other means designed |
|---|
| 22 | 22 | | to recover the cost]. |

| 23 | 23 | | SECTION 2. The changes in law made by this Act apply to a |
|---|
| 24 | 24 | | retiree of the Teacher Retirement System of Texas regardless of |
|---|
| 25 | 25 | | whether the person retired from employment before, on, or after the |
|---|
| 26 | 26 | | effective date of this Act. |
|---|
| 27 | 27 | | SECTION 3. The changes in law made by this Act apply |
|---|
| 28 | 28 | | beginning with the 2023-2024 school year. |
|---|
| 29 | 29 | | SECTION 4. This Act takes effect immediately if it receives |
|---|
| 30 | 30 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 31 | 31 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 32 | 32 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 33 | 33 | | Act takes effect September 1, 2023. |
