55 relating to the punishment for the offense of indecent exposure;
66 increasing a criminal penalty.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 21.08(b), Penal Code, is amended to read
99 as follows:
1010 (b) An offense under this section is a Class B misdemeanor,
1111 except that the offense is:
1212 (1) a Class A misdemeanor if it is shown on the trial
1313 of the offense that the defendant has been previously convicted one
1414 time of an offense under this section; and
1515 (2) a state jail felony if it is shown on the trial of
1616 the offense that the defendant has been previously convicted two or
1717 more times of an offense under this section.
1818 SECTION 2. The change in law made by this Act applies only
1919 to an offense committed on or after the effective date of this Act.
2020 An offense committed before the effective date of this Act is
2121 governed by the law in effect on the date the offense was committed,
2222 and the former law is continued in effect for that purpose. For
2323 purposes of this section, an offense was committed before the
2424 effective date of this Act if any element of the offense occurred
2525 before that date.
2626 SECTION 3. This Act takes effect September 1, 2023.
