| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Section 618.003, Government Code, is amended to |
|---|
| 9 | 9 | | read as follows: |
|---|
| 10 | 10 | | Sec. 618.003. AUTHORITY FOR FACSIMILE SIGNATURE. (a) An |
|---|
| 11 | 11 | | [Except as provided by Section 618.004, an] authorized officer may |
|---|
| 12 | 12 | | execute, authenticate, certify, or endorse or authorize to be |
|---|
| 13 | 13 | | executed, authenticated, certified, or endorsed with the officer's |
|---|
| 14 | 14 | | facsimile signature instead of the officer's manual signature: |
|---|
| 15 | 15 | | (1) a public security, instrument of payment, or |
|---|
| 16 | 16 | | certificate of assessment, if the use of the facsimile signature is |
|---|
| 17 | 17 | | authorized by the board, body, or officer empowered to authorize |
|---|
| 18 | 18 | | the issuance of the security, instrument, or certificate; or |
|---|
| 19 | 19 | | (2) an eligible contract, if the use of the facsimile |
|---|
| 20 | 20 | | signature is authorized by the governing body of the municipality. |
|---|
| 21 | 21 | | (b) A facsimile signature of the comptroller, or of a deputy |
|---|
| 22 | 22 | | designated in writing to act for the comptroller, may be placed on a |
|---|
| 23 | 23 | | public security required to be registered by the comptroller or a |
|---|
| 24 | 24 | | certificate on that security. |
|---|
| 25 | 25 | | SECTION 2. Section 618.004, Government Code, is repealed. |
|---|
| 26 | 26 | | SECTION 3. This Act takes effect September 1, 2023. |
