44 AN ACT
55 relating to ticket sales for charitable raffles conducted by the
66 charitable foundations of certain professional sports teams.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 2004.004, Occupations Code, is amended
99 by adding Subsections (a-1), (a-2), (a-3), and (a-4) and amending
1010 Subsection (d) to read as follows:
1111 (a-1) Raffle tickets for a charitable raffle conducted
1212 under Subsection (a) may be sold:
1313 (1) at the home venue or rodeo venue of the
1414 professional sports team associated with the foundation conducting
1515 the raffle; or
1616 (2) through digital interactive media, including an
1717 Internet website of or mobile application provided by the
1818 professional sports team associated with the foundation conducting
1919 the raffle.
2020 (a-2) Raffle tickets for a charitable raffle conducted
2121 under Subsection (a) may be sold only during the period beginning
2222 when the venue opens to attendees of the game or rodeo venue opens
2323 to attendees of the rodeo event and ending when the draw to
2424 determine the prize winners for the raffle concludes.
2525 (a-3) Raffle tickets sold under Subsection (a-1)(2) may
2626 only be sold to individuals who at the time of the sale are
2727 physically located inside the home venue or rodeo venue of the
2828 professional sports team associated with the foundation conducting
2929 the raffle.
3030 (a-4) Subsection (a-1)(2) does not authorize the use of an
3131 Internet website or mobile application to provide a graphic or
3232 dynamic animation that corresponds to the outcome of a winning or
3333 losing raffle ticket.
3434 (d) Only persons 18 years of age or older may purchase
3535 raffle tickets in a charitable raffle conducted under this chapter.
3636 A professional sports team charitable foundation that conducts a
3737 charitable raffle under Subsection (a) shall contract with a
3838 third-party vendor to ensure only persons 18 years of age or older
3939 purchase tickets for the raffle.
4040 SECTION 2. This Act takes effect immediately if it receives
4141 a vote of two-thirds of all the members elected to each house, as
4242 provided by Section 39, Article III, Texas Constitution. If this
4343 Act does not receive the vote necessary for immediate effect, this
4444 Act takes effect September 1, 2023.
