5 | 5 | | relating to ticket sales for charitable raffles conducted by the |

6 | 6 | | charitable foundations of certain professional sports teams. |

7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

8 | 8 | | SECTION 1. Section 2004.004, Occupations Code, is amended |
---|
9 | 9 | | by adding Subsections (a-1), (a-2), (a-3), and (a-4) and amending |
---|
10 | 10 | | Subsection (d) to read as follows: |
---|
11 | 11 | | (a-1) Raffle tickets for a charitable raffle conducted |
---|
12 | 12 | | under Subsection (a) may be sold: |
---|
13 | 13 | | (1) at the home venue or rodeo venue of the |
---|
14 | 14 | | professional sports team associated with the foundation conducting |
---|
15 | 15 | | the raffle; or |
---|
16 | 16 | | (2) through digital interactive media, including an |
---|
17 | 17 | | Internet website of or mobile application provided by the |
---|
18 | 18 | | professional sports team associated with the foundation conducting |
---|
19 | 19 | | the raffle. |
---|
20 | 20 | | (a-2) Raffle tickets for a charitable raffle conducted |
---|
21 | 21 | | under Subsection (a) may be sold only during the period beginning |
---|
22 | 22 | | when the venue opens to attendees of the game or rodeo venue opens |
---|
23 | 23 | | to attendees of the rodeo event and ending when the draw to |
---|
24 | 24 | | determine the prize winners for the raffle concludes. |
---|
25 | 25 | | (a-3) Raffle tickets sold under Subsection (a-1)(2) may |
---|
26 | 26 | | only be sold to individuals who at the time of the sale are |
---|
27 | 27 | | physically located inside the home venue or rodeo venue of the |
---|
28 | 28 | | professional sports team associated with the foundation conducting |
---|
29 | 29 | | the raffle. |
---|
30 | 30 | | (a-4) Subsection (a-1)(2) does not authorize the use of an |
---|
31 | 31 | | Internet website or mobile application to provide a graphic or |
---|
32 | 32 | | dynamic animation that corresponds to the outcome of a winning or |
---|
33 | 33 | | losing raffle ticket. |
---|
34 | 34 | | (d) Only persons 18 years of age or older may purchase |
---|
35 | 35 | | raffle tickets in a charitable raffle conducted under this chapter. |
---|
36 | 36 | | A professional sports team charitable foundation that conducts a |
---|
37 | 37 | | charitable raffle under Subsection (a) shall contract with a |
---|
38 | 38 | | third-party vendor to ensure only persons 18 years of age or older |
---|
39 | 39 | | purchase tickets for the raffle. |
---|
40 | 40 | | SECTION 2. This Act takes effect immediately if it receives |
---|
41 | 41 | | a vote of two-thirds of all the members elected to each house, as |
---|
42 | 42 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
43 | 43 | | Act does not receive the vote necessary for immediate effect, this |
---|
44 | 44 | | Act takes effect September 1, 2023. |
