55 relating to the period for which a pesticide must be registered.
66 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
77 SECTION 1. Section 76.041, Agriculture Code, is amended by
88 amending Subsection (g) and adding Subsection (g-1) to read as
99 follows:
1010 (g) Except as provided by Subsection (g-1), a [A] pesticide
1111 that has been registered with the department must continue to be
1212 registered until the earlier of:
1313 (1) the second anniversary of the date the registrant
1414 stops distributing the pesticide in this state; or
1515 (2) the date no [as long as the] pesticide remains in
1616 the channels of trade in this state. [The registrant shall ensure
1717 that the pesticide continues to be registered.]
1818 (g-1) A registrant that initiates a recall of a pesticide
1919 from distribution in this state before the pesticide's registration
2020 expires is not required to continue to register the pesticide after
2121 the expiration date.
2222 SECTION 2. This Act takes effect September 1, 2023.
