55 AN ACT
66 relating to the redaction of certain information from a document
77 posted on the Internet by a county clerk or district clerk on
88 request of a person to whom the information relates or the judicial
99 security division of the Office of Court Administration of the
1010 Texas Judicial System.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 552.117, Government Code, is amended by
1313 amending Subsection (b) and adding Subsection (b-1) to read as
1414 follows:
1515 (b) Except as provided by Subsection (b-1), all [All]
1616 documents filed with a county clerk and all documents filed with a
1717 district clerk are exempt from this section.
1818 (b-1) A county clerk or district clerk shall on request of a
1919 person to whom this section applies redact information described by
2020 Subsection (a) from the electronic image of a document posted by the
2121 clerk on an Internet website that relates to the person making the
2222 request if the clerk has the ability to electronically redact the
2323 information from the electronic image of the posted document. A
2424 county clerk or district clerk shall on request of the judicial
2525 security division of the Office of Court Administration of the
2626 Texas Judicial System redact information described by Subsection
2727 (a) in the manner and under the conditions prescribed by this
2828 subsection. A clerk that redacts an electronic image of a posted
2929 document under this subsection shall include on the website a
3030 statement advising members of the public that one or more documents
3131 posted on the website have been redacted as required by state law.
3232 SECTION 2. Section 552.1175, Government Code, is amended by
3333 amending Subsection (e) and adding Subsection (e-1) to read as
3434 follows:
3535 (e) Except as provided by Subsection (e-1), all [All]
3636 documents filed with a county clerk and all documents filed with a
3737 district clerk are exempt from this section.
3838 (e-1) A county clerk or district clerk shall on request of a
3939 person to whom this section applies redact information described by
4040 Subsection (b) from the electronic image of a document posted by the
4141 clerk on an Internet website that relates to the person making the
4242 request if the clerk has the ability to electronically redact the
4343 information from the electronic image of the posted document. A
4444 county clerk or district clerk shall on request of the judicial
4545 security division of the Office of Court Administration of the
4646 Texas Judicial System redact information described by Subsection
4747 (b) in the manner and under the conditions prescribed by this
4848 subsection. A clerk that redacts an electronic image of a posted
4949 document under this subsection shall include on the website a
5050 statement advising members of the public that one or more documents
5151 posted on the website have been redacted as required by state law.
5252 SECTION 3. This Act takes effect immediately if it receives
5353 a vote of two-thirds of all the members elected to each house, as
5454 provided by Section 39, Article III, Texas Constitution. If this
5555 Act does not receive the vote necessary for immediate effect, this
5656 Act takes effect September 1, 2023.
