6	6	relating to the redaction of certain information from a document
7	7	posted on the Internet by a county clerk or district clerk on
8	8	request of a person to whom the information relates or the judicial
9	9	security division of the Office of Court Administration of the
10	10	Texas Judicial System.
11	11	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
12	12	SECTION 1. Section 552.117, Government Code, is amended by
13	13	amending Subsection (b) and adding Subsection (b-1) to read as
14	14	follows:
15	15	(b) Except as provided by Subsection (b-1), all [All]
16	16	documents filed with a county clerk and all documents filed with a
17	17	district clerk are exempt from this section.
18	18	(b-1) A county clerk or district clerk shall on request of a
19	19	person to whom this section applies redact information described by
20	20	Subsection (a) from the electronic image of a document posted by the
21	21	clerk on an Internet website that relates to the person making the
22	22	request if the clerk has the ability to electronically redact the
23	23	information from the electronic image of the posted document. A
24	24	county clerk or district clerk shall on request of the judicial
25	25	security division of the Office of Court Administration of the
26	26	Texas Judicial System redact information described by Subsection
27	27	(a) in the manner and under the conditions prescribed by this
28	28	subsection. A clerk that redacts an electronic image of a posted
29	29	document under this subsection shall include on the website a
30	30	statement advising members of the public that one or more documents
31	31	posted on the website have been redacted as required by state law.
32	32	SECTION 2. Section 552.1175, Government Code, is amended by
33	33	amending Subsection (e) and adding Subsection (e-1) to read as
34	34	follows:
35	35	(e) Except as provided by Subsection (e-1), all [All]
36	36	documents filed with a county clerk and all documents filed with a
37	37	district clerk are exempt from this section.
38	38	(e-1) A county clerk or district clerk shall on request of a
39	39	person to whom this section applies redact information described by
40	40	Subsection (b) from the electronic image of a document posted by the
41	41	clerk on an Internet website that relates to the person making the
42	42	request if the clerk has the ability to electronically redact the
43	43	information from the electronic image of the posted document. A
44	44	county clerk or district clerk shall on request of the judicial
45	45	security division of the Office of Court Administration of the
46	46	Texas Judicial System redact information described by Subsection
47	47	(b) in the manner and under the conditions prescribed by this
48	48	subsection. A clerk that redacts an electronic image of a posted
49	49	document under this subsection shall include on the website a
50	50	statement advising members of the public that one or more documents
51	51	posted on the website have been redacted as required by state law.
52	52	SECTION 3. This Act takes effect immediately if it receives
53	53	a vote of two-thirds of all the members elected to each house, as
54	54	provided by Section 39, Article III, Texas Constitution. If this
55	55	Act does not receive the vote necessary for immediate effect, this
56	56	Act takes effect September 1, 2023.
