55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the applicability of certain laws governing public
88 school discipline and law and order to a school district of
99 innovation.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 12A.004(a), Education Code, is amended
1212 to read as follows:
1313 (a) A local innovation plan may not provide for the
1414 exemption of a district designated as a district of innovation from
1515 the following provisions of this title:
1616 (1) a state or federal requirement applicable to an
1717 open-enrollment charter school operating under Subchapter D,
1818 Chapter 12;
1919 (2) Subchapters A, C, D, and E, Chapter 11, except that
2020 a district may be exempt from Sections 11.1511(b)(5) and (14) and
2121 Section 11.162;
2222 (3) state curriculum and graduation requirements
2323 adopted under Chapter 28;
2424 (4) Chapter 37; and
2525 (5) [(4)] academic and financial accountability and
2626 sanctions under Chapters 39 and 39A.
2727 SECTION 2. Section 12A.004(a), Education Code, as amended
2828 by this Act, applies only to a local innovation plan adopted or
2929 renewed on or after the effective date of this Act. A local
3030 innovation plan adopted or renewed before the effective date of
3131 this Act is governed by the law in effect on the date the plan was
3232 adopted or renewed, and the former law is continued in effect for
3333 that purpose.
3434 SECTION 3. This Act takes effect immediately if it receives
3535 a vote of two-thirds of all the members elected to each house, as
3636 provided by Section 39, Article III, Texas Constitution. If this
3737 Act does not receive the vote necessary for immediate effect, this
3838 Act takes effect September 1, 2023.
