55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to a state employment preference for certain individuals
88 who reside with veterans with a disability.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 657.002, Government Code, is amended to
1111 read as follows:
1212 Sec. 657.002. INDIVIDUALS QUALIFIED FOR VETERAN'S
1313 EMPLOYMENT PREFERENCE. The following individuals qualify for a
1414 veteran's employment preference:
1515 (1) a veteran, including a veteran with a disability;
1616 (2) a veteran's surviving spouse who has not
1717 remarried; [and]
1818 (3) an orphan of a veteran if the veteran was killed
1919 while on active duty; and
2020 (4) an individual who resides in a household with a
2121 veteran if the individual is the primary source of income for the
2222 household and the veteran:
2323 (A) has a total disability rating based either on
2424 having a service-connected disability with a disability rating of
2525 100 percent or on individual unemployability; and
2626 (B) is receiving Supplemental Security Income
2727 (SSI) benefits under 42 U.S.C. Section 1381 et seq. or Social
2828 Security Disability Insurance (SSDI) benefits under 42 U.S.C.
2929 Section 401 et seq.
3030 SECTION 2. Section 657.003(b), Government Code, is amended
3131 to read as follows:
3232 (b) A state agency shall provide to an individual entitled
3333 to a veteran's employment preference for employment or appointment
3434 over other applicants for the same position who do not have a
3535 greater qualification a veteran's employment preference, in the
3636 following order of priority:
3737 (1) a veteran with a disability;
3838 (2) a veteran;
3939 (3) a veteran's surviving spouse who has not
4040 remarried; [and]
4141 (4) an orphan of a veteran if the veteran was killed
4242 while on active duty; and
4343 (5) an individual who resides with a veteran with a
4444 disability as described by Section 657.002(4) if the individual is
4545 the primary source of income for the veteran's household.
4646 SECTION 3. Section 657.005(b), Government Code, is amended
4747 to read as follows:
4848 (b) An applicant who is either a veteran with a disability
4949 as described by Section 657.002(4) or an individual who resides
5050 with a veteran with a disability as described by Section 657.002(4)
5151 if the individual is the primary source of income for the veteran's
5252 household shall furnish the official records to the individual
5353 whose duty is to fill the position.
5454 SECTION 4. The changes in law made by this Act apply only to
5555 an open position with a state agency for which the state agency
5656 begins accepting applications on or after the effective date of
5757 this Act. An open position with a state agency for which the state
5858 agency begins accepting applications before the effective date of
5959 this Act is governed by the law in effect on the date the state
6060 agency began accepting applications, and the former law is
6161 continued in effect for that purpose.
6262 SECTION 5. This Act takes effect September 1, 2023.
