55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the qualifications for serving as a member of the board
88 of directors of a municipal utility district.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 54.102, Water Code, is amended to read as
1111 follows:
1212 Sec. 54.102. QUALIFICATIONS FOR DIRECTORS. To be qualified
1313 to serve as a director, a person shall:
1414 (1) be at least 18 years old;
1515 (2) be [,] a resident citizen of the State of Texas;
1616 [,] and
1717 (3) [either] own land subject to taxation in the
1818 district [or be a qualified voter within the district].
1919 SECTION 2. The change in law made by this Act does not
2020 affect the entitlement of a member serving immediately before the
2121 effective date of this Act on the board of directors of a municipal
2222 utility district operating under Chapter 54, Water Code, to
2323 continue to carry out the board's functions for the remainder of the
2424 member's term. The change in law applies only to a member of the
2525 board of directors of such a district elected or appointed on or
2626 after the effective date of this Act. This Act does not prohibit a
2727 person who is a member of the board of directors of such a district
2828 on the effective date of this Act from being reelected or
2929 reappointed to the board if the person has the qualifications
3030 required for a member under Section 54.102, Water Code, as amended
3131 by this Act.
3232 SECTION 3. This Act takes effect September 1, 2023.
