66 AN ACT
77 relating to authorizing school districts to provide funding using
88 money received under the Foundation School Program to
99 community-based organizations for purposes of reimbursing private
1010 employers for paid internships provided to certain students in
1111 career and technology education programs in the district.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subchapter F, Chapter 29, Education Code, is
1414 amended by adding Section 29.1871 to read as follows:
1515 Sec. 29.1871. CONTRACT TO REIMBURSE FOR PAID INTERNSHIP.
1616 (a) In this section, "community-based organization" has the
1717 meaning assigned by Section 303.001, Labor Code.
1818 (b) To encourage private employers to participate with
1919 school districts in providing career and technology education to
2020 assist students in developing the knowledge, skills, and
2121 competencies necessary for a broad range of career opportunities,
2222 the board of trustees of a school district may contract with a
2323 community-based organization to:
2424 (1) match students in grade 11 or 12 who are
2525 participating in a career and technology education program in the
2626 district with paid internships or similar programs provided by
2727 private employers; and
2828 (2) reimburse private employers for all or part of the
2929 cost of providing paid internships or similar programs to students
3030 described by Subdivision (1) using funds provided to the
3131 community-based organization by the district.
3232 (c) A contract described by Subsection (b) must:
3333 (1) require each paid internship or similar program
3434 provided to the school district's students to primarily promote a
3535 public purpose of the district relating to career and technology
3636 education;
3737 (2) include provisions under which the school district
3838 is granted sufficient control to ensure that the public purpose
3939 under Subdivision (1) is accomplished and the district receives the
4040 return benefit; and
4141 (3) ensure that each student employed under a paid
4242 internship or similar program is paid at least the minimum wage
4343 required by law.
4444 (d) In providing funds to a community-based organization
4545 for the purposes of reimbursing a private employer under a contract
4646 under Subsection (b), the school district may use funds allocated
4747 to the district for career and technology education under Section
4848 48.106.
4949 (e) A community-based organization with which a school
5050 district contracts under Subsection (b) may serve as the employer
5151 of record for a student employed under a paid internship or similar
5252 program provided under a contract described by Subsection (b).
5353 (f) Completion of a paid internship or similar program
5454 provided under a contract described by Subsection (b) may satisfy a
5555 requirement to complete a practicum as part of a school district's
5656 career and technology education program.
5757 SECTION 2. Section 48.106(c), Education Code, is amended to
5858 read as follows:
5959 (c) At least 55 percent of the funds allocated under this
6060 section must be used:
6161 (1) in providing career and technology education
6262 programs in grades 7 through 12; or
6363 (2) in providing funding to a community-based
6464 organization under a contract entered into under Section 29.1871
6565 for purposes of reimbursing private employers for providing paid
6666 internships or similar programs to students in career and
6767 technology education programs.
6868 SECTION 3. This Act takes effect September 1, 2023.
