| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 11.179(a), Education Code, is amended to |
|---|
| 10 | 10 | | read as follows: |
|---|
| 11 | 11 | | (a) The board of trustees of a school district may adopt a |
|---|
| 12 | 12 | | policy allowing the consumption, possession, and sale of an |
|---|
| 13 | 13 | | alcoholic beverage at an event held at a performing arts facility |
|---|
| 14 | 14 | | owned by the district if: |
|---|
| 15 | 15 | | (1) the facility is leased to a nonprofit organization |
|---|
| 16 | 16 | | for an event not sponsored or sanctioned by the district; and |
|---|
| 17 | 17 | | (2) the district is located in: |
|---|
| 18 | 18 | | (A) a county: |
|---|
| 19 | 19 | | (i) [(A)] that has a population of not more |
|---|
| 20 | 20 | | than 300,000; and |
|---|
| 21 | 21 | | (ii) [(B)] in which a component university |
|---|
| 22 | 22 | | of the University of Houston System is located; or |
|---|
| 23 | 23 | | (B) a county in which is located a facility |
|---|
| 24 | 24 | | described by Subdivision (1) within two miles of two or more |
|---|
| 25 | 25 | | stadiums with a capacity of at least 40,000 people. |

| 26 | 26 | | SECTION 2. This Act takes effect September 1, 2023. |
