9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Section 3.005, Election Code, is amended by | |
11 | 11 | adding Subsection (e) to read as follows: | |
12 | 12 | (e) A special election ordered by the governor to fill a | |
13 | 13 | vacancy in the legislature or in congress shall be ordered not later | |
14 | 14 | than the seventh day after a vacancy occurs. | |
15 | 15 | SECTION 2. Section 201.051(a), Election Code, is amended to | |
16 | 16 | read as follows: | |
17 | 17 | (a) If a vacancy in office is to be filled by special | |
18 | 18 | election, the election shall be ordered as soon as practicable | |
19 | 19 | after the vacancy occurs, subject to Subsection (b) and Section | |
20 | 20 | 3.005(e). | |
21 | 21 | SECTION 3. This Act takes effect September 1, 2023. |
