55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the venue for prosecution of misdemeanor cases in
88 justice courts.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Article 4.12(a), Code of Criminal Procedure, is
1111 amended to read as follows:
1212 (a) Except as otherwise provided by this article, a
1313 misdemeanor case to be tried in justice court shall be tried:
1414 (1) in the precinct in which the offense was
1515 committed;
1616 (2) in the precinct in which the defendant or any of
1717 the defendants reside;
1818 (3) with the written consent of the state and each
1919 defendant or the defendant's attorney, in any other precinct within
2020 the county; or
2121 (4) if the offense was committed in a county with a
2222 population of 3.3 million or more, in any precinct that is:
2323 (A) [in the county that is] adjacent to the
2424 precinct in which the offense was committed; and
2525 (B) located in that county.
2626 SECTION 2. The change in law made by this Act applies only
2727 to a misdemeanor case that is initially filed in a justice court on
2828 or after the effective date of this Act, regardless of whether the
2929 offense for which the case is filed occurred before, on, or after
3030 the effective date of this Act.
3131 SECTION 3. This Act takes effect September 1, 2023.
