66 AN ACT
77 relating to certain requirements for activation of the Texas
88 National Guard into active combat duty.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter A, Chapter 437, Government Code, is
1111 amended by adding Section 437.0055 to read as follows:
1212 Sec. 437.0055. CONGRESSIONAL ACTION REQUIRED FOR ACTIVE
1313 COMBAT DUTY ACTIVATION OF TEXAS NATIONAL GUARD. (a) In this
1414 section, "active combat duty" means active military service
1515 through:
1616 (1) participation in an armed conflict in a foreign
1717 state;
1818 (2) performance of a hazardous service relating to an
1919 armed conflict in a foreign state; or
2020 (3) performance of a duty through an instrumentality
2121 of war.
2222 (b) Notwithstanding any other provision of this code, the
2323 Texas National Guard may be activated into active combat duty only
2424 if the United States Congress:
2525 (1) officially declares war in accordance with Clause
2626 11, Section 8, Article I, United States Constitution; or
2727 (2) takes other official action in accordance with
2828 Clause 15, Section 8, Article I, United States Constitution.
2929 (c) The governor shall take all actions necessary to comply
3030 with this section.
3131 SECTION 2. This Act takes effect September 1, 2023.
