66 AN ACT
77 relating to an exception to certain reporting requirements for
88 health care providers reviewing information on maternal mortality
99 and morbidity for the Texas Maternal Mortality and Morbidity Review
1010 Committee.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 34.008, Health and Safety Code, is
1313 amended by adding Subsection (e) to read as follows:
1414 (e) Notwithstanding any other law and for purposes of this
1515 chapter, a health care provider, including a nurse, who during the
1616 review of information relevant to a case of pregnancy-associated
1717 death, pregnancy-related death, or severe maternal morbidity
1818 obtained under this chapter learns of conduct related to the
1919 provider's profession that is subject to a reporting requirement is
2020 exempt from that reporting requirement for the reviewed
2121 information.
2222 SECTION 2. This Act takes effect immediately if it receives
2323 a vote of two-thirds of all the members elected to each house, as
2424 provided by Section 39, Article III, Texas Constitution. If this
2525 Act does not receive the vote necessary for immediate effect, this
2626 Act takes effect September 1, 2023.
