| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 34.008, Health and Safety Code, is |
|---|
| 13 | 13 | | amended by adding Subsection (e) to read as follows: |
|---|
| 14 | 14 | | (e) Notwithstanding any other law and for purposes of this |
|---|
| 15 | 15 | | chapter, a health care provider, including a nurse, who during the |
|---|
| 16 | 16 | | review of information relevant to a case of pregnancy-associated |
|---|
| 17 | 17 | | death, pregnancy-related death, or severe maternal morbidity |
|---|
| 18 | 18 | | obtained under this chapter learns of conduct related to the |
|---|
| 19 | 19 | | provider's profession that is subject to a reporting requirement is |
|---|
| 20 | 20 | | exempt from that reporting requirement for the reviewed |
|---|
| 21 | 21 | | information. |
|---|
| 22 | 22 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 23 | 23 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 24 | 24 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 25 | 25 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 26 | 26 | | Act takes effect September 1, 2023. |
